Ccm6tional Use Feint •- Hiner M, )2 <br />City of Lake Elmo <br />Washington County, Minnesota <br />Resolution No. 2002- 08 <br />A RESOLUTION GRANTING A <br />CONDITIONAL USE PERMIT <br />FOR A GOLF PRACTICE FACILITY TO <br />HIKER DEVELOPMENT <br />WHEREAS, Hiner Development, Inc. has made application to the City of Lake <br />Ehaio for a Conditional Use Permit allowing a Golf Practice Facility as a commercial <br />recreation use in the AG Zoning District based on plans staff dated January 23, 2002, at a <br />parcel of land legally described as: <br />That part of the Northeast Quarter of the Southeast Quarter of Section 34, <br />Township 29, Range 21, Washington County, Minnesota, lying westerly of <br />Washington County Highway Right of Way Plat No. 48-19B. <br />WHEREAS, the Lake Elmo Planning Commission considered this Conditional Use <br />Permit request at its January 28, 2002 meeting, and recommended that the Conditional Use <br />Permit be granted. <br />NOW, THEREFORE, BE IT RESOLVED that a Conditional Use Permit is <br />hereby granted by the City Council to Hiner Development, Inc., and, <br />BE IT FURTHER RESOLVED, that this Conditional Use Permit is granted <br />subject to the following conditions: <br />1. Elimination of the "mini-golf" use based on use characteristics <br />unrelated to the primacy golf practice facility use. <br />2. Limitation to the scale of the food service and golf pro shop <br />accessory uses to that represented by the applicant's floor plans <br />dated by Staff January 23, 2002. <br />3. All buildings, signage, and parking areas shall be subject to review <br />and approval by the City of a formal Section 520 Site Plan. <br />Commercial zoning district performance standards shall apply to <br />those improvements. <br />4. Any structure with a gross floor area exceeding 5,000 square feet <br />shall have fire suppression sprinklers installed. <br />
