CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2004-012 <br />A RESOLUTION APPROVING THE OPEN SPACE CONCEPT PLAN <br />FOR WHISTLING VALLEY SECOND ADDITION <br />WHEREAS, Bald Eagle Development and David Sorenson have made application <br />for an OP Concept Plan for Whistling Valley Second Addition to create 18 single family <br />building sites on a parcel of 45 acres east of, and adjacent to, the Whistling Valley OP <br />approved by the City in 2003. <br />WHEREAS, at its January 26, 2004 meeting, the Lake Elmo Planning <br />Commission conducted a Public Hearing and reviewed and recommended approval of <br />this application based on the following findings: <br />1. The Concept Plan is consistent with the goals, objectives and policies of the <br />Comprehensive Plan. <br />2. The Concept Plan is consistent with the purpose of the Open Space <br />Preservation Ordinance. <br />3. The Concept Plan, except as noted by the January 22, 2004, Planning Staff <br />Report, complies with the development standards of the Open Space <br />Ordinance. <br />WHEREAS, the Concept Plan of Whistling Valley Second Addition was <br />presented to the City Council at this February 3, 2004 City Council Meeting. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council does <br />hereby approve and accept the Open Space Concept Plan of Whistling Valley Second <br />Addition, per plans staff dated February 3, 2004 based on the recommendation of the <br />Planning Commission as to the Findings and subject to the following condition: <br />1. Approval by the City Council of a 4/5 OP Variance to permit an 85 foot OP <br />Buffer for proposed Lot 1, Block 1 (extreme Southwest lot). <br />ADOPTED, by the Lake Ehno.Cit Council this. 3`d day ofFebruary, 2004. <br />Lee Hunt, Mayor <br />AT'T'EST: <br />Charles E.
