CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2007- 018 <br />A RESOLUTON APPROVING SEPTIC DRAIN FIELD SETBACK VARIANCES <br />REQUESTED BY JEFF AND CLAUDIA ANDERSON AT 11225 31sT ST. NORTH <br />WHEREAS, Jeff and Claudia Anderson has made application to the City of Lake <br />Elmo for a variance from drain field setback standards to the property line (3 feet where <br />10 feet is required and a dwelling (13 feet where 20 feet is required) at 11225 31" St. <br />North, Lake Elmo, Minnesota. <br />WHEREAS, the Lake Elmo Planning Commission considered these variance <br />requests at its February 12, 2007, meeting, and recommended that the variances be <br />granted based on the following Findings: <br />1. The property can not be put to reasonable use without the granting of the <br />variance requested. The physical constraints of the lot mandate the proposed <br />site as the only location possible for a new drainfield. <br />2. The variance requested does result from physical circumstances found on this <br />property. <br />3. Granting of the variance will not change the essential character of the <br />neighborhood. <br />WHEREAS, the Lake Elmo City Council has reviewed the septic drain field <br />setback variances requested by Jeff and Claudia Anderson, 11225 31" St. North at the <br />February 20, 2007 meeting. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lake Elm City Council hereby <br />approves septic drain field setback variance requested by Jeff and Claudia Anderson, <br />11225 31 "St. North, based on Findings of the February 15, 2007 Planning Staff Report <br />and plans staff dated January 1. 1, 2007. <br />
