A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO VALLEY <br />BRANCH A.! DISTRICT <br />!_ _ . GRADING <br />i,D' <br />FLOODPLAIN TO FACILITATE THE REMOVAL OF A CULVERT LOCATED <br />AT RALEIGH CREEK AND FORMER 28TI STREET NORTH. <br />WHEREAS, the Valley Branch Watershed District have requested a Conditional <br />Use Permit to allow for grading activity within a floodway. <br />WHEREAS, the g=rading activity is intended. to facilitate the removal of a culvert <br />located at Raleigh Creek and the former 281` Street North. <br />WHEREAS, the City Engineer issued a report dated January 117/2013, <br />highlighting the City's expectations related to the Raleigh Creek culvert removal project. <br />WHEREAS, the Lake Elmo Planning Commission held a Public Hearing on <br />January 14, 2013, and reviewed and recommended approval of the Conditional Use <br />Pen -nit to allow for grading within a floodway. <br />NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council <br />hereby approves the Conditional Use Permit requested by the Valley Branch Watershed <br />District to remove the culvert located at Raleigh Creek and the former 281h Street North. <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF LAKE ELMO TH19 <br />FIFTH DAY <br />i TZarson <br />Mayor <br />ATTEST: <br />Adam Be11 <br />City Clerk <br />Resolution 2013-06 <br />
