City Council <br /> Date: 5/1/07 <br /> REGULAR <br /> Item: 5 <br /> Motion <br /> <br />ITEM: Consider a stipulation agreement with the Sunfish Lake Homeowners <br />Associations (HOA) related to wastewater <br /> <br />SUBMITTED BY: Jerry Filla, City Attorney <br /> Tom Bouthilet, Finance Director <br /> <br />REVIEWED BY: Susan Hoyt, City Administrator <br /> Representatives of Sunfish Lake HOA <br />_________________________________________________________________________ <br />SUMMARY AND ACTION REQUESTED: The city council is being asked to approve a <br />negotiated stipulation agreement between the Hamlet on Sunfish Lake and the city to address the <br />the handling of wastewater. Representatives of the Hamlet on Sunfish Lake and the city have <br />been discussing solutions to wastewater treatment issues resulting from failing waste systems in <br />the Hamlet for several months. The two parties recently came to an agreement on how to resolve <br />this issue. The staff recommends approving the agreement. <br /> <br />KEY TERMS: <br /> <br />• The HOA will construct improvements to the wastewater system at its own costs. <br /> <br />• The HOA will connect to sanitary sewer when it becomes available. <br /> <br />RECOMMENDATION <br /> <br />Amicably resolving the wastewater treatment issues with Sunfish Lake is to the city’s and the <br />Sunfish Lake HOA’s best interest.
