STAFF REPORT
DATE: 4/15/2025
CONSENT

TO: Mayor and Council
FROM: Jason Stopa, Community Development Director
AGENDA ITEM: Approve an Amendment to the Cell Tower Lease with Verizon/VB
Acquisitions and Consent to a Sublease between Verizon/VB Acquisitions
and T-Mobile West, LLC
REVIEWED BY: Ashley Monterusso, City Planner

CORE STRATEGIES:

☐ Vibrant, inclusive, connected community ☐ Efficient, reliable, innovative services
☐ Responsive, transparent, adaptive governance ☒ Balanced Finances now and future
☐ Managed Growth ☒ Resilient Infrastructure

BACKGROUND:
VB Acquisitions (Verizon) owns a monopole cell tower located at 11351 Upper 33rd St. (PID
13.029.21.31.0018) which is owned by the City of Lake Elmo. Their lease dated July 17, 2018, states that
the city shall consent to a sublease between third parties. VB Acquisitions would like to add T-Mobile to
the site.

ISSUE BEFORE COUNCIL:
Would the City Council consent to allowing co-location of T-Mobile to the tower site and amending the
lease with VB Acquisitions?

PROPOSAL DETAILS/ANALYSIS:
Verizon owns the monopole, and the city owns the site. Verizon is seeking to sublease to T-Mobile who
plans to co-locate and add a platform with 3 antennas with 6 antennas. Antennas co-located on an existing
wireless communications facility structure are approved through an administrative review. The plans are
attached showing the improvements. The lease requires consent and with consent the City can request
additional funds or amend the terms of the agreement. Staff recommend that the rate increase from $1872
to $2122/month, which would become effective after the agreement is signed. The change would also
eliminate consent within the approved premises boundary but require a $200 additional monthly rate
increase for additional wireless tenant. Verizon will send an amended contract if the changes are approved.
The existing lease, consent form, and T-Mobile plan sheets are attached.

FISCAL IMPACT:
The rate would increase $250/month and additional tenants would pay $200.

OPTIONS:
• Approve the amendment and consent to the sublease
• Deny the amendment and consent to the sublease
• Amend the request
• Table for further information
