Page 2 ~ ~- ~~ ~'` <br />Council Minutes <br />12/21 /94 <br />UPDATE ON THE PROPOSED 1995 ALLEY RECONSTRUCTION PLANS <br />Engineer Maurer reported that an informational meeting was held on December 6, <br />1994 at the city hall with residents who will be affected by the alley reconstruction <br />project. Questions and comments were received and minutes of the meeting will be <br />mailed to all property owners along the affected alleys. Maurer said the next step is <br />to schedule a formal public hearing and suggested the hearing be held February 8, <br />1995. Councilmember Jacobs made the motion to hold the hearing on February 8, <br />1995. The motion passed unanimously. <br />A PROPOSED RESOLUTION ADOPTING A COMPREHENSIVE PLAN AMENDMENT <br />FOR AN INTERIM STRATEGY FOR NONPOINT SOURCE <br />POLLUTION CONTROL <br />Administrator Hoyt explained that the Metropolitan Council is requiring cities to adopt <br />an interim strategy for nonpoint source pollution control for future development. <br />These standards primarily apply to new development and since Falcon Heights is fully <br />developed, they have little impact on the city but nevertheless are a required element <br />in the city's comprehensive plan. The standards may impact how the city handles the <br />quality of stormwater runoff in the future. The Planning Commission unanimously <br />recommended adopting the proposed amendment and Councilmember Hustad made <br />a motion to approve resolution 94-29 approving a comprehensive plan amendment for <br />an interim strategy for nonpoint source pollution control. The motion passed <br />unanimously. <br />CONSIDERATION OF AN AMENDMENT TO THE TERM OF THE <br />COMMERCIAL DEVELOPMENT MORATORIUM, CHAPTER 5, SECTION 5.04 <br />Administrator Hoyt explained that under the interim development moratorium on <br />commercial uses, one use, stores that sell firearms, remains under the moratorium <br />which expires December 31, 1994. Hoyt said that staff is continuing to gather <br />information from other cities and the planning commission and staff recommend that <br />council amend the ordinance to extend the interim commercial development <br />moratorium from December 31, 1994 to March 31, 1995. She said that its legal limit <br />would be September 30, 1995. The extension should allow time for the staff to <br />complete its research and for the planning commission and city council to complete <br />the process to review and adopt the appropriate ordinances. However, Administrator <br />Hoyt stated that meeting this deadline would require working very efficiently and not <br />accommodating any delays that might occur in the process.
