MINUTES <br />REGULAR CITY COUNCIL MEETING ~ V <br />MARCH 27, 1985 V <br />PAGE 3 <br />until a later date. Council discussed at length concerns over the <br />timing of construction, setting the bond sale, and date of application <br />for a building permit. Mr. Kubitschek assured they would be applying <br />for a foundation permit around May 1 and should have a complete set of <br />plans and apply for a building permit around June 1. Following the <br />discussion, the matter of the bond sale was deferred until the meeting <br />of May 8, 1985. Mayor Eggert moved, seconded by Councilmember Hard, <br />that Resolution R-85-11 be approved. Motion carried unanimously. <br />RESOLUTION R-85-11 RESOLUTION <br />R-85-11 <br />A RESOLUTION ORDERING PLANS AND SPECIFICATIONS FOR <br />STREETS AND UTILITIES IN TAX INCREMENT FINANCING <br />DISTRICT N0. 2 IN DEVELOPMENT DISTRICT N0. 1 <br />Council discussed the scheduling of the spring clean up. Attorney Gasteazoro <br />expressed concern that the City could be liable in the event hazardous SPRING CLEAN <br />materials are deposited at the dump site unless the hauler is made liable UP SCHEDULED <br />for proper disposal. Councilmember Hard moved, seconded by Mayor Eggert, FOR 5/10/85 <br />that the dump be scheduled for May 10 through May 19, 1985 subject to SUBJECT TO <br />approval of the haulers contract by the City Attorney. Motion carried REVIEW BY <br />unanimously. Councilmember Ciernia will contact the Fairgrounds regarding ATTORNEY <br />a site for the dump and will make them aware of the hazardous waste concern. <br />Engineer Schunicht presented and briefly summarized proposed agreements for <br />the Central Ramsey, Southeast Ramsey and Middle Mississippi Watersheds. He <br />explained that the agreements have been reviewed by the technical staffs WATERSHED <br />of the involved communities, and the Engineer recommended approval of the AGREEMENTS <br />agreements. The documents have also been forwarded to the City Attorney DEFERRED TO <br />for review. Mr. Schunicht explained that the Commission has no power 4/10/85 <br />to bond or do projects but will act as an arbitrator. Following a <br />discussion, Mayor Eggert moved, seconded by Councilmember Ciernia, that <br />the matter be deferred to April 10, 1985 to allow time for Council and <br />the Attorney to review the matter, and for a summary of the City's <br />liabilities under the agreements to be prepared. <br />Councilmember Hard .brought to Council's attention the condition of the CONDITION OF <br />walkway to the south of Falcon Woods No. 3. He commented on ponding of WALKWAY SOUTH <br />water on the walkway and the difficulty of riding a bike on the walkway OF FALCON <br />due to the curb. Engineer Schunicht explained that the walkway was WOODS 3 <br />not graded properly and the contractor has been told to remedy the problem. DISCUSSED <br />Clerk Administrator Barnes will obtain quotes on the cost of removal of <br />the curb. <br />Attorney Gasteazoro presented a proposed ordinance amending <br />portions of the City code relating to permitted uses in the retail <br />business district and repair of vehicles on City streets. Following <br />a short discussion, Mayor Eggert moved, seconded by Councilmember <br />Chenoweth, that the matter be referred to the Planning Commission, and <br />a public hearing be scheduled for April 24, 1985 at 7:15 P.M. and that <br />publication be authorized. Motion carried unanimously. <br />Engineer Schunicht explained that request for payment of $1,713.60 to $1,713.60 <br />Bituminous Roadways for Falcon Woods No. 3 was due to the fact that PAYMENT TO <br />the amount had inadvertently been left off the request for final payment. BITUMINOUS <br />Councilmember Chenoweth moved, seconded by Mayor Eggert, that the re- ROADWAYS <br />quest for payment be approved. Motion carried unanimously. APPROVED <br />F.W. ~~3 <br />
