MINUTES <br />REGULAR CITY COUNCIL MEETING <br />SEPTEMBER 11, 1985 <br />PAGE 2 <br />Councilmember Baldwin moved, seconded by Councilmember Hard, that MINUTES OF <br />the Minutes of August 28, 1985 be approved as presented. Upon a vote 8/28/85 <br />being taken, the following voted. in favor thereof: Councilmembers APPROVED <br />Ciernia, Chenoweth, Baldwin, and Hard, and the following voted against <br />the same: None. Mayor Eggert abstained. Motion carried. <br />Mayor Eggert presented a variance request from Alice M. Robertson, DRIVEWAY <br />1741 Holton, to replace the existing driveway which is approximately VARIANCE <br />twelve inches from the lot line. Mrs. Robertson questioned the need FOR A. <br />for the variance as the driveway has been in that location for 40 ROBERTSON, <br />years and there is no other area in which it could be placed. Attorney 1741 HOLTON, <br />Gasteazoro explained that the driveway was originally constructed prior GRANTED <br />to the existence of the City Code, but that the Code definitely requires <br />all driveways must be placed no closer than five feet to the lot line, <br />therefore, a variance is required. Mayor Eggert moved, seconded by <br />Councilmember Ciernia, that the variance be granted as recommended by <br />the Planning Commission at their September 9th meeting. Motion <br />carried unanimously. <br />Councilmember Ciernia moved, seconded by Councilmember Hard, that <br />Resolution R-85-33 be adopted. Motion carried unanimously. <br />RESOLUTION R-85-53 RESOLUTION <br />R-85-53 <br />A RESOLUTION AUTHORIZING THE COUNTY AUDITOR TO REDUCE THE <br />DEBT LEVY BY $25,600 IN THE YEAR 1986, WHICH WAS TO BE <br />PROVIDED FOR IN THE GENERAL OBLIGATION TAX INCREMENT (525M) <br />OF SEPTEMBER 1, 1985 <br />At 7:15 P.M. Mayor Eggert opened the Public Hearing on a conditional PUBLIC <br />use request from James and Janice Bykowski, 1745 St. Mary's, to HEARING ON <br />construct a utility shed and presented the Affidavit of Publication. CONDITIONAL <br />Mr. Bykowski was in attendance to answer any questions, however, there USE - JAMES <br />were no others in attendance wishing to be heard. Clerk Administrator BYKOWSKI, <br />Barnes informed Mr. Bykowski that if the utility shed is constructed as 1745 ST. <br />indicated on the conditional use request form, it will be necessary that MARYS <br />he obtain a building permit (the structure will be over 100 square feet) <br />and that the conditional use must be recorded with Ramsey County. Mayor BYKOWSKI <br />Eggert closed the public hearing at 7:21 P.M. Mayor Eggert then moved, CONDITIONAL <br />seconded by Councilmember Ciernia, that the conditional use request be USE GRANTED <br />granted. Motion carried unanimously. UTILITY SHED <br />Engineer Schunicht addressed the possibility of doing a survey on the STORM & <br />age and condition of the City storm and sanitary sewers, and SANITARY <br />recommended that Council consider at least doing a sanitary sewer SEWER <br />rate study at this time, however, the storm sewer study could wait STUDY <br />until the Watershed Act is in place. Council and the Engineer DISCUSSED <br />discussed the life expectancy of the sewers (60 to 80 years) <br />after which the discussion was deferred until after the public <br />hearing scheduled for 7:30 P.M. <br />Mayor Eggert opened the Public Hearing on a proposal for a commercial PUBLIC <br />facilities development project (Falcon Heights Office Park) and HEARING ON <br />presented the Affidavits of Publication.
