MINUTES <br />SPECIAL CITY COUNCIL MEETING <br />JANUARY 7, 1982 <br />PAGE 2 <br />Larry Stowe, 1954 Autumn, inquired if this action would affect or in- <br />fluence future deliberations by the Planning Commission and Council <br />regarding the PUD request of American Shelter Corporation. Mayor <br />Warkentien explained that the reason the City needs to purchase a strip <br />60° beyond the City°s boundary line is so the City will not landlocl~ <br />the property to the north no matter who develops it, and then become <br />liabile for damages for the landlocked condition. He also stated that, <br />in no way, would the agreements have any bearing on future decisions re- <br />garding development of the land. <br />Attorney Swanson assured that there was no reference to PUD or use of the <br />balance of either parcel in the negotiations and the appraisal indicates <br />the price being paid represents the fair market value with no other <br />considerations. <br />Mayor Warkentien informed that Council had moved very cautiously in the <br />matter under the guidance of Attorney Swanson and Attorney Galvin and <br />that there are no entanglements. <br />n <br />U <br /> <br />Council discussed continuing or cancelling the Public Hearing scheduled <br />for January 20, 1982 in view of the fact that the Planning Commission <br />has not, as yet, acted upon the PUD request and has continued their <br />Public Hearing to February 1, 1982. Attorney Swanson informed that the <br />Public Meeting should convene and could then be continued to a later <br />date. However, sine= no formal continuation date could be scheduled <br />at this time, Attorney Swanson recommended the Hearing be cancelled. <br />Councilmember Eggert moved, seconded by Councilmember Larson, that the <br />City Council Public Hearing scheduled for January 20, 1982 be cancelled <br />and that the Clerk Administrator be authorized to publish the same. <br />Motion carried unanimously. <br />Councilmember Eggert requested authorization to present two Cable <br />`fV documents (the. by-laws aid the proposed method by which the Cable <br />Commission will be voting upon the applicants) to the City Attorney <br />in order that he may ascertain whether or not the proposed method <br />by which the Cable Commission will be voting upon the applicants <br />are in accordance with the by-laws. Councilmember Eggert moved, <br />seconded by Mayor Warkentien that the documents be reviewed by <br />Attorney Swanson for his opinion.
