MINUTES <br />REGULAR. CITY COUNCIL MEETING <br />SEPTEMBER 28, 1983 <br />PAGE 5 <br />periodically during the Harvest Fest on G ctober 9, 1983 at the Gibbs <br />Farm. Motion carried unanimously. <br />Mayor Warkentien referred to a letter dated September 2, 1983 from Al <br />Thovson, 1938 Autumn St., regarding the City~s request that the hedge <br />on his property be trimmed to comply with City ordinances. Mr. Thovson, <br />who was in attendance, informed that he has trimmed his hedge 20 feet back <br />from Autumn. Attorney Gasteazoro suggested that the City Engineer check <br />to determine if the trimming had been accomplished in a proper manner <br />because the City has that liability. Mr. Thovson suggested that compliance <br />with the stop signs placed on Prior and Autumn should be enforced because <br />of the additional traffic generated by the Good Value Homes pro3ect. <br />Following a short discussion, Mayor Warkentien moved, seconded by Council- <br />member Ciernia, that Resolution 83-35 be adopted. Motion carried unanimously. <br />RESOLUTION $3-35 <br />A RESOLUTION LEVYING TAXES FOR THE YEAR 1983, <br />COLLDC TIBILE IN 198l~ ($503, 845) <br />Councilmember Larson reviewed the problems inherent with the anti-fall <br />device for the hose tower as well as the problems experienced by the City <br />of Woodbury. She questioned where the liability would be if the chains <br />were installed on the hose tower and were not used. After further <br />discussion, Attorney Gasteazoro was directed to im-estigate the possibility <br />of petitioning for relief from the OSHA requirements. The matter was <br />deferred to the next Council meeting. <br />Mayor Warkentien moved, seconded by Councilmeanber Chestovich, to direct <br />the City Engineer to investigate whether plans have been previously <br />prepared to change the size of the waterline 'from Fairview to Cleveland, <br />and and if not, to prepare the necessary pl ais. Motion carried unanimously. <br />Councilmember Eggert reviewed the budget for the North Suburban Cable <br />Commission. He also explained that Group W has proposed to downgrade <br />its system- and some of the technological changes have been accepted, with <br />reservations. Councilmeinber Eggert felt the reason for the downgrade <br />request may be to make the system similar to the one proposed in St. Paul <br />which would be helpful if Group W elects to sell the franchise. He also <br />commented on the fact that Group W is behind on the construction schedule <br />and the Commission can levy a $5,000 per day fine against the company if <br />the systeaa is not fully operational by April 21. <br />Mayor Warkentien presented a statement on charges from Howard Dahlgren <br />Associates for the Larpenteur/Snelling planning. He felt there might <br />be a conflict of interest since the Dahlgren firm has been or is <br />presently employed by Embers and all three alternatives in the Larpenteur/ <br />Snelling plan eliminates the Municipal Liquor Store but leaves Embers <br />intact. Councilmeanber Ciernia pointed out that the Dahlgren firm <br />is also very close to the commercial development in the City of Roseville, <br />but that it would probably be difficult to find a planning firm <br />that would not have some inter-relationship with others in the area. <br />After further discussion, Councilmember Chestovich moved, seconded by <br />Councilmember Larson, that payment be approved. Mayor Warkentien offered <br />an amendment to the motion that the $90.00 be deleted from the fee for <br />the consultation with Henry Kristal of Embers. After a discussion, Mayor <br />Warkentien withdrew the amendment.
