r1 <br />u <br />1 <br />MINUTES <br />SPECIAL CITY COUNCIL MEETING <br />MARCH 19, 1980 <br />PAGE 4 <br />Clerk Administrator Barnes explained that Northern States Power will <br />service only a few of the street lights in the University Grove area <br />making it necessary to hire an electrical contractor to repair the <br />remainder. He suggested several solutions -continue repairing the <br />lights at the City's expense, to assess the residents for repair of <br />the ornamental lights, or replace the ornamental lights with wooden <br />poles and high pressure sodium lights. After a discussion Council <br />directed the Clerk Administrator to meet with the University Grove <br />Association and present possible solutions to the problem. <br />Engineer Lemberg informed Council that Allan Martin, 1802 Arona, has ALLAN MARTIN' <br />filed a complaint regarding damage to his house and driveway during GARDEN AVENUE <br />the reconstruction of Garden Avenue. Engineer Lemberg and Clerk COMPLAINT <br />Administrator Barnes had examined the driveway and did not feel it <br />was a problem. The Engineer will forward the letter of complaint to <br />the contractors for their consideration. <br />Attorney Kenefick presented to Council information regarding the City's CITY LIABILITY <br />liability insurance, as had been requested previously. He explained that INSURANCE <br />a statute passed by the State Legislature negates governmental immunity DISCUSSION <br />which had been the practice in the past. However, the statute also states <br />that the numicipality is only liable up to $300,000 for multiple claims <br />arising from a single occurance, and may claim immunity above that amount. <br />If desired the governing body may insure for broader coverage and this <br />action would then increase the liability to the amount of increased in- <br />surance provided. He also explained that even though individual council <br />persons should be named in a lawsuit against the City, the City would <br />be responsible. <br />Engineer Lemberg requested that Council authorize him to prepare plans 1980 SEALCOATING <br />and specifications for the 1980 sealcoating of the northwest quadrant <br />of the City. Mayor Warkentien moved, seconded by Councilmember Eggert, <br />that the engineer be authorized to prepare the plans for the 1980 seal- <br />coating. Motion carried unanimsouly. <br />Clerk Administrator Barnes requested Council's permission to destroy <br />some unofficial documents and letters, and bills which have been paid, <br />and are over ten years old. He explained that this can be done by reso- <br />lution as provided by state law. Mayor Warkentien moved, seconded by <br />Councilmember Brown that such a resolution be adopted. Motion carried <br />unanimously. <br />RESOLUTION 80-9 <br />02~ <br />UNIVERSITY GROVE <br />LIGHTING <br />RESOLUTION 80-9 <br />A RESOLUTION AUTHORIZING THE CLERK ADMINISTRATOR <br />TO DESTROY CERTAIN RECORDS OF THE CITY OF FALCON <br />HEIGHTS UNDER MINNESOTA STATUTE 412.841 SUBDIVISIONS <br />1 AND 2 <br /> <br />Clerk Administrator Barnes also requested permission to .dispose of a <br />Smith Corona Typewriter which has been inoperable since 1974. It was <br />suggested that the typeweriter be offered to Goodwill Industries or <br />the Salvation Army. Councilmember Larson moved, seconded by Council- <br />member Brown that the Clerk Administrator be authorized to give the <br />typewriter to some orgainization which might make us of it.
