r1 u 1 MINUTES SPECIAL CITY COUNCIL MEETING MARCH 19, 1980 PAGE 4 Clerk Administrator Barnes explained that Northern States Power will service only a few of the street lights in the University Grove area making it necessary to hire an electrical contractor to repair the remainder. He suggested several solutions -continue repairing the lights at the City's expense, to assess the residents for repair of the ornamental lights, or replace the ornamental lights with wooden poles and high pressure sodium lights. After a discussion Council directed the Clerk Administrator to meet with the University Grove Association and present possible solutions to the problem. Engineer Lemberg informed Council that Allan Martin, 1802 Arona, has ALLAN MARTIN' filed a complaint regarding damage to his house and driveway during GARDEN AVENUE the reconstruction of Garden Avenue. Engineer Lemberg and Clerk COMPLAINT Administrator Barnes had examined the driveway and did not feel it was a problem. The Engineer will forward the letter of complaint to the contractors for their consideration. Attorney Kenefick presented to Council information regarding the City's CITY LIABILITY liability insurance, as had been requested previously. He explained that INSURANCE a statute passed by the State Legislature negates governmental immunity DISCUSSION which had been the practice in the past. However, the statute also states that the numicipality is only liable up to $300,000 for multiple claims arising from a single occurance, and may claim immunity above that amount. If desired the governing body may insure for broader coverage and this action would then increase the liability to the amount of increased in- surance provided. He also explained that even though individual council persons should be named in a lawsuit against the City, the City would be responsible. Engineer Lemberg requested that Council authorize him to prepare plans 1980 SEALCOATING and specifications for the 1980 sealcoating of the northwest quadrant of the City. Mayor Warkentien moved, seconded by Councilmember Eggert, that the engineer be authorized to prepare the plans for the 1980 seal- coating. Motion carried unanimsouly. Clerk Administrator Barnes requested Council's permission to destroy some unofficial documents and letters, and bills which have been paid, and are over ten years old. He explained that this can be done by reso- lution as provided by state law. Mayor Warkentien moved, seconded by Councilmember Brown that such a resolution be adopted. Motion carried unanimously. RESOLUTION 80-9 02~ UNIVERSITY GROVE LIGHTING RESOLUTION 80-9 A RESOLUTION AUTHORIZING THE CLERK ADMINISTRATOR TO DESTROY CERTAIN RECORDS OF THE CITY OF FALCON HEIGHTS UNDER MINNESOTA STATUTE 412.841 SUBDIVISIONS 1 AND 2 Clerk Administrator Barnes also requested permission to .dispose of a Smith Corona Typewriter which has been inoperable since 1974. It was suggested that the typeweriter be offered to Goodwill Industries or the Salvation Army. Councilmember Larson moved, seconded by Council- member Brown that the Clerk Administrator be authorized to give the typewriter to some orgainization which might make us of it.
