X21 <br />MINUTES <br />SPECIAL CITY COUNCIL MEETING <br />MARCH 19, 1980 <br />PAGE 3 <br />Larson that Attorney Kenefick be directed to draft an ordinance for the BILLBOARDS <br />purpose of phasing out billboards in the City of Falcon Heights and (cont.) <br />present it for Council's approval at a future meeting. Motion carried <br />unanimously. <br />Clerk Administrator Barnes informed Council that the State of Minnesota MILEAGE RATE <br />has advised that no city can pay employees or elected officials a mile- REDUCED TO <br />age rate in excess of 19G p.er mile. The city had previously established 19~ PER MILE <br />a rate of 20G per mile and that will now be reduced to 19C per mile. <br />Attorney Kenefick explained to Council that the widow of Henry Dachtera DACHTERA~ <br />(a volunteer fireman who died of a heart attack while on duty as a CLAIM <br />"sleeper" for the Falcon Heights Fire Department) has filed a claim UNDER THE __ <br />through the Peace Officers Benefit Act. This act was established to PEACE OFFICE <br />provide benefits to survivors of peace officers who are killed in the BENEFIT ACT <br />line of duty. <br />Mrs. Dachtera has requested that the City certify that Mr. Dachtera <br />was killed in the line of duty and Attorney Kenefick stated that he <br />did not feel the City could make such a certification within the mean- <br />ing of the Statute and suggested that a letter be drafted explaing <br />the facts in the case and that the City is not sure the matter falls <br />within the Statute. Mayor Warkentien moved, seconded by Councilmember <br />Larson that Attorney Kenefick be directed to write a letter presenting <br />the facts rather than signing the certification as was requested. <br />Motion carried unanimously. <br />Councilmember Eggert inquired as to whether or not firemen for the City ROUTINE <br />are required to have physical examinations periodically in order to PHYSICALS FOR <br />avoid future incidents similar to the Dachtera case. Councilmember FIREMEN <br />Steele explained that firemen are required to have a physical before DISCUSSED <br />being accepted in the Department but routine examinations are not <br />required at this time. A discussion on the subject followed and the <br />matter was deferred to the next meeting to allow time to check with <br />other communities as to how they handle the problem. <br />Clerk Administrator Barnes requested permission ,to set May 9 through SPRING DUMP <br />18 as the date for the City's spring clean up. Mayor Warkentien moved MAY 9 - 18 <br />seconded by Councilmember Brown that the spring clean up dates be May <br />9 through 18, 1980. Motion carried unanimously. <br />Clerk Administrator Barnes informed Council that State Representative PROPOSEDT TO <br />Mike Fritz has attached to the proposed bill to increase the levy limit, <br />an amendment increasing the population requirement from 2,500 to 6,000. LEVY LIMIT <br />If approved this would mean that communities under 6,000 (which includes LAW <br />Falcon Heights) would be excluded from the levy limit. <br />Clerk Administrator Barnes presented a tabulation of policing costs COST OF <br />for the liquor store determining that the cost of $5,000 per year. POLICING <br />LIQUOR STORE <br />Councilmember Steele moved, seconded by Mayor Warkentien that $5,000 <br />from the liquor fund be applied to the policing contract. Motion <br />carried unanimously. <br />Mayor Warkentien brought to Council's attention that Mrs. Labalestra LIDO OWNER- <br />has sold her interest in the Lido Cafe to Lido Cafe, Inc., Gene Gasparro, SHIP <br />and Scott Blomgren. This information is required for holders of liquor <br />licenses. <br />
