MINUTES <br />REGULAR CITY COUNCIL MEETING <br />SEPTEMBER 10, 1980 <br />PAGE 2 <br />Mr. and Mrs. T. A. Salminen, 1740 Holton, were in attendance together <br />with their neighbors, Mrs. John O'Keefe, 1743 Albert, and Mrs. H. G. Ewan, <br />1749 Albert, to request a solution to the problem of the walkway which <br />had been used as a driveway in the past, but is barricaded at the present <br />time. Councilmember Larson informed those in attendance that the Planning <br />Commission had studied the situation and recommends that the entire walk- <br />way be vacated in order that the four homeowners with property adjoining <br />the walkway may surface the area and use it for access to their garages. <br />Councilmember Larson moved, seconded by Councilmember Brown, that the walk-i <br />way between 1740 and 1746 Holton and 1743 and 1749 Albert be vacated as <br />recommended by the Planning Commission. Motion carried unanimously. <br />Councilmember Larson moved, seconded by Councilmember Steele that Reso- <br />lution 80-23A be adopted calling for a public hearing on the vacation <br />and authorizing publication and posting of same. Motion carried unani- <br />mously. <br />RESOLUTION 80-23A <br />A RESOLUTION CALLING FOR A PUBLIC HEARING ON EASEMENT <br />VACATION <br />Mayor Warkentien moved, seconded by Councilmember Eggert that in view <br />of Council's acceptance of the Planning Commission's recommendation <br />to vacate the walkway, the barricades presently there be removed. <br />Motion carried unanimously. <br />Mayor Warkentien informed Council that Clement Lehnen, owner of Falcon <br />Lanes, Inc, has requested permission to install a sign on the building <br />which houses his business. Councilmember Larson explained that Mr. <br />Lehnen had attended the Planning Commission Meeting and that the <br />Commission was unable to determine whether or not the sign could be <br />considered a flashing sign, which would not comply with the Zoning <br />Ordinance. Council discussed the matter and decided the sign in <br />question is a flashing sign and cannot be allowed. Councilmember <br />Steele moved, seconded by Councilmember Eggert that the request be <br />denied on the basis that it is a flashing sign, which is prohibited <br />by Ordinance $64. Motion carried unanimously. <br />Russell Bull, 1810 Arona, addressed Council regarding a neighbor's tree <br />(1816 Arona) which was struck by lightening and a branch fell into <br />Mr. Bull's yard damaging his garage, fence and camper. Mr. Bull is <br />concerned that the remainder of the tree could fall on his property <br />causing further damage and had requested! the City Tree Inspector check <br />the tree and make a recommendation regarding possible removal of the <br />tree. Attorney Renefick advised that according to Ordinance #86, the <br />City Horticulturist does have the authority to order removal of a <br />tree if he considers it hazardous to public safety or is a public <br />nuisance. Dr. French, City Horticulturist, has exmained the tree <br />and will make a recommendation. <br />Mayor Warkentien presented to Council a request from the Minnesota <br />Cycling Team to barricade the north bald of Commonwealth Avenue for <br />their fund raiser to be held Sunday, October 12, 1980 from 10:00 a.m. <br />to 3:00 p.m. Councilmember Steele moved, seconded by Councilmember <br />Brown that the request be granted.
