MINUTES <br />REGULAR CITY COUNCIL MEETING <br />SEPTEMBER 10, 1980 <br />PAGE 3 <br />Attorney Kenefick presented for Council's consideration a proposed Drug <br />Paraphernalia Ordinance. After a short discussion Councilmember Eggert <br />moved, seconded by Mayor Warkentien that Ordinance 172 be adopted as <br />presented and that the Clerk Administrator be authorized to publish <br />same. Motion carried unanimously. <br />ORDINANCE 4/172 <br />AN ORDINANCE OF THE CITY OF FALCON HEIGHTS, MINNESOTA <br />ADOPTING CERTAIN PROVISIONS OF MINNESOTA STATUTES CHAP- <br />TER 152 BY REFERENCE AND ADDING PROVISIONS RELATING TO <br />AND PROHIBITING THE POSSESSION, MANUFACTURE, DELIVERY OR <br />ADVERTISING OF DRUG PARAPHERNALIA <br />Clerk Administrator Barnes requested Council's approval of his hiring of <br />Alan Benoit as a full time Liquor Store Clerk at a salary of $750.00 per <br />month. Mayor Warkentien moved, seconded by Councilmember Steele that <br />the hiring of Alan Benoit be approved. Motion carried unanimously. <br />Councilmember Larson informed Council that Mrs. LeTourneau-Shafer, 1816 <br />Arona, whose neighbors have objected to vans and a pickup being parked <br />on the front lawn, were not at the Planning Commission Meeting so no <br />action was taken. The Commission did recommend that Mrs. LeTourneau- <br />Shafer get letters of consent from the adjacent neighbors if she is <br />to be allowed to continue parking in that area. Attorney Kenefick <br />was of the opinion that if the driveway is 5 feet from the lot line <br />there is no violation of the ordinances, but that it could be requested <br />that the area be surfaced properly. Councilmember Larson moved, seconded <br />by Mayor Warkentien that the Clerk Administrator be authorized to in- <br />form Mrs. LeTourneau-Shafer of the Attorney's opinion and to stipulate <br />that the area must be properly surfaced by June 1, 1981. Motion carried <br />unanimously. <br />~f <br />ORDINANCE <br />44172 <br />ALAN BENOIT <br />HIRED AS <br />LIQUOR STORE <br />CLERK $750 <br />PER MONTH <br />LETOURNEAU- <br />SHAFER FRONT <br />YARD PARK- <br />ING DISCUSS- <br />ION <br />Councilmember Larson informed Council that the Planning Commission has CHANGE IN <br />requested that the section of the Comprehensive Plan which addresses COMPREHENSIi~ <br />the extension of Fairview, be deleted. Councilmember Larson moved that PLAN APPROVE <br />the deletion be approved. Councilmember Eggert seconded the motion which <br />carried unanimously. <br />Councilmember Steele expressed alarm at the fact that the additional <br />security devices have not as yet been installed at the Liquor Store. <br />He stated he felt the Clerk Administrator was remiss in his duties <br />in that he allowed Floyd Security to continue postponing the in- <br />stallation for 3 months. The Clerk Administrator explained that the <br />device ordered, when finally delivered, was not the proper size and <br />could not be used. Councilmember Larson stated she felt that perhaps <br />the Council was also remiss as they were aware of the Liquor Store <br />problem. <br />The Clerk Administrator is checking into the possibility of changing <br />security firms in order to get better service. Mayor Warkentien <br />moved, seconded by Councilmember Steele that the Clerk Administrator <br />be authorized to choose a firm to install security devices in the <br />store and service same.
