MINUTES REGULAR CITY COUNCIL MEETING SEPTEMBER 10, 1980 PAGE 3 Attorney Kenefick presented for Council's consideration a proposed Drug Paraphernalia Ordinance. After a short discussion Councilmember Eggert moved, seconded by Mayor Warkentien that Ordinance 172 be adopted as presented and that the Clerk Administrator be authorized to publish same. Motion carried unanimously. ORDINANCE 4/172 AN ORDINANCE OF THE CITY OF FALCON HEIGHTS, MINNESOTA ADOPTING CERTAIN PROVISIONS OF MINNESOTA STATUTES CHAP- TER 152 BY REFERENCE AND ADDING PROVISIONS RELATING TO AND PROHIBITING THE POSSESSION, MANUFACTURE, DELIVERY OR ADVERTISING OF DRUG PARAPHERNALIA Clerk Administrator Barnes requested Council's approval of his hiring of Alan Benoit as a full time Liquor Store Clerk at a salary of $750.00 per month. Mayor Warkentien moved, seconded by Councilmember Steele that the hiring of Alan Benoit be approved. Motion carried unanimously. Councilmember Larson informed Council that Mrs. LeTourneau-Shafer, 1816 Arona, whose neighbors have objected to vans and a pickup being parked on the front lawn, were not at the Planning Commission Meeting so no action was taken. The Commission did recommend that Mrs. LeTourneau- Shafer get letters of consent from the adjacent neighbors if she is to be allowed to continue parking in that area. Attorney Kenefick was of the opinion that if the driveway is 5 feet from the lot line there is no violation of the ordinances, but that it could be requested that the area be surfaced properly. Councilmember Larson moved, seconded by Mayor Warkentien that the Clerk Administrator be authorized to in- form Mrs. LeTourneau-Shafer of the Attorney's opinion and to stipulate that the area must be properly surfaced by June 1, 1981. Motion carried unanimously. ~f ORDINANCE 44172 ALAN BENOIT HIRED AS LIQUOR STORE CLERK $750 PER MONTH LETOURNEAU- SHAFER FRONT YARD PARK- ING DISCUSS- ION Councilmember Larson informed Council that the Planning Commission has CHANGE IN requested that the section of the Comprehensive Plan which addresses COMPREHENSIi~ the extension of Fairview, be deleted. Councilmember Larson moved that PLAN APPROVE the deletion be approved. Councilmember Eggert seconded the motion which carried unanimously. Councilmember Steele expressed alarm at the fact that the additional security devices have not as yet been installed at the Liquor Store. He stated he felt the Clerk Administrator was remiss in his duties in that he allowed Floyd Security to continue postponing the in- stallation for 3 months. The Clerk Administrator explained that the device ordered, when finally delivered, was not the proper size and could not be used. Councilmember Larson stated she felt that perhaps the Council was also remiss as they were aware of the Liquor Store problem. The Clerk Administrator is checking into the possibility of changing security firms in order to get better service. Mayor Warkentien moved, seconded by Councilmember Steele that the Clerk Administrator be authorized to choose a firm to install security devices in the store and service same.
