City Council Minutes <br />May 28, 1997 <br />Page 3 <br />33;~ <br />After discussing the proposed licensing requirements, Councilmember Kuettel suggested <br />that the council consider removing pool halls as a conditional use and, therefore, not <br />allow the use in Falcon Heights because of the close proximity of these establishments <br />to residential uses. Attorney Galatz indicated that, unlike adult uses, pool halls do not <br />have constitutional protections under the first amendment. Falcon Heights does not <br />have to allow every type of use to exist in the city. <br />Motion was made by Councilmember Kuettel to direct the planning commission to hold <br />the required public hearing on removing pool halls as a conditional use in a B-3 zone and <br />to declare a moratorium on pool hall uses. Motion passed unanimously. <br />CONSIDERATION OF RESOLUTION 97-17, RELATED TO THE LARPENTEUR AVENUE <br />STREETSCAPE PROJECT <br />Motion was made by Councilmember Gibson Talbot to approve Resolution 97-17, <br />accepting bids for the landscaping and electrical improvements for the Larpenteur <br />Avenue streetscape project. Motion passed unanimously. <br />Motion was made by Councilmember Jacobs to direct the project designer to negotiate <br />change orders regarding the spare streetlight poles and to eliminate the textured <br />pavement. Motion passed unanimously. <br />Bid package C of the project will continue to be reviewed. Staff will be meeting with the <br />State Fair regarding its portion of the project.
