I~INUTEs <br />SPECIAL COUNCIL P'lEETING <br />FEBRUARY 9, 1977 <br />page 2 <br />"~ <br />Council reviewed the qualifications of the three applicants for the APPOINTMENT OF <br />position of City Horticulturist. The three applicants were Dr. Gustad CITY HORTICUL- <br />Hard, City Horticulturist for Falcon Heights for the past 16 years, TURIST FOR 1977 <br />Dr. David W. French, Plant Pathologist at the University of Minnesota <br />and George Munzenrider, Horticulturist of Sunfish Lake. <br />Council discussed at lengtdl the City's current system and methods of re- <br />moval of Dutch Elm diseased trees. It was noted by Councilmembers and <br />the Administrative staff that many complaints had been made, by citizens <br />and the Administrative staff itself, concerning many seemingly unnecessary <br />delays in the present system. It was noted that after citizens reported <br />a tree with suspected Dutch Elm disease, many times there were long delays <br />before inspection, marking and removal notification. <br />After further discussion, Councilman Labalestra moved and it was seconded <br />by Councilman Black to appoint Dr. David W. French as City Horticulturist <br />for the year of 1977. Upon a vote being taken the following voted "aye": <br />Councilmen Black, Ecklund, Steele and Labalestra and the following voted <br />"nay": Mayor Warkentien. Motion carried. <br />Council discussed Attorney Kenefick's letter in regard to "snow fences". <br />Since some homeowners have kept their snow fences erected in their front <br />yards after being notified they were in violation of section l~.7 of <br />Ordinance 6L~, it has become necessary for a definition of the term. <br />Some homeowners have argued that since snow fences are of a temporary <br />nature, they need not comply with section l~.7. <br />Attorney Kenefick found that even though snow fences might be of a <br />temporary nature, they would be considered a "structure" under the <br />ordinance and all setback requirements would have to be followed. <br />Council directed Clerk-Administrator 3arnes to write a letter to resi- <br />dents concerned and inform them of Attorney Kenefick's findings and <br />also let them know they may apply for a Variance to erect their snow <br />fences. <br />Mayor Warkentien read a resolution opposing the proposed Ramsey County <br />Municipal Court change. He noted we have received a number of other <br />similar resolutions from surrounding communities. Councilman Ecklund <br />stated that the Ramsey County League of Local Governments was also in <br />opposition to the legislation. <br />Councilman Steele moved and it was seconded by Mayor Warkentien to <br />authorize Clerk-Administrator Barnes to draf t a resolution stating that <br />the City of Falcon Heights is in opposition to legislation altering the <br />Ramsey County Municipal Court System and to send copies of the resolution <br />to every Ramsey County legislator and all individual members of the <br />Ramsey County League of Municipalities. <br />DISCUSSION ON <br />SNOW FENCES - <br />VARIENCE REQUIRED <br />RESOLUTION 77-6 <br />OPPOSING LEGIS- <br />LATION ALTERING <br />THE RAMSEY COUNTY <br />MUNICIPAL COURT <br />SYSTEM <br />Upon a vote being taken the following voted "aye": Mayor Warkentien, <br />Councilmen Black, Ecklund, Steele and Labalestra and the following <br />voted "nay": None. Motion carried. <br />
