MINUTES <br />MARCH 10, 1977 <br />pace 2 `~ <br />~ ~~ <br />Clerk-Administrator Barnes read the official publication on notine of PUffi,IC HEARING <br />assessment hearing for the Arona Avenue Storm Sewer Project 1976-1. AROMA AVE. AREA <br />STORM SEWER IM- <br />Engineer Leaaberg read the actual costs of the project and stated that PROVEMENT 2976-1 <br />only the main trunk line would be assessed in the amount of $10,592.00 <br />plus engineering, legal and contingency fees for a total assessment to <br />each lot of $174.33. <br />Mr. David Anderson, 1512 W. Idaho Avenue inquired if the City would <br />suffer ar~p- penalties if the project were not assessed and paid for out <br />of the General Revenue Fund. Acting Mayor Black stated there would <br />be no penalty but that the City's policy has bean to assess aL projects <br />such as this. <br />Harold W. Green, ].Li82 W. Idaho stated that from his house east to the <br />corner, the water stands in the street and does not drain. Therefore, <br />he claims, he does not benefit from the project and doesn't feel he <br />should have to pay for the assessment. <br />Ralph Reed, 1485 W. Idaho stated he has lived at his present address <br />since 1947 and has been trying to get curb and gutter since 1948. <br />He claims the high point of the street is at the manhole in front of <br />].189 and he is the first lot east. He stated there is water standing <br />in front of his home constantly. The water extends six feet from the <br />curb. He said the project does not benefit his property and he doesn't <br />want to be assessed. <br />Don Madole, ].4,79 W. Idaho submitted photographs to Council, showing <br />water standing in front of his home. He stated there is no drainage <br />to the west. He further stated he sees no apparent benefit to his <br />property from the project and therefore doesn't feel he should be <br />assessed. <br />Elmer Weltzin, 11178 W. Idaho stated his property is not benefitted <br />from the project and thinks he is being unfairly taxed. <br />Bngineer Lemberg replied that the Storm Sewer district was based on <br />street centerline grades. H® stated that even though at the present <br />time there does not seem to be any apparent benefit to some of the <br />property owners, there was a future benefit. He further stated that <br />in the future if curb 'and gutter is installed on Idaho Avenu®, the <br />trunk line would pick up the water. Therefore, he stated, the resi- <br />dents were being assessed for future benefits. <br />Acting Mayor Black moved adoption of Resolution 77-0 and it was second- RESOLTTION 77-9 <br />ed by Councilman Steele. ADOPTION OF <br />ASSESSMENT ROLL <br />RESOLUTION 77-9 FOR AROMA AVENUE <br />STORM SEWER PROJ. <br />A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR <br />~ AROMA AREA STORM SEWER PROJECT 1976-1 <br />Resolution 77-9 sets the payment period at 5 years with interest of <br />8K per annum. <br />Upon a vote being taken the following voted "aye°: Acting Mayor Black, <br />
