10 <br />may not be reconstructed if the structure is destroyed <br />to an extent greater than 50~ of its value; <br />WHEREAS, the proposed purchaser of the Lindig green- <br />house desires an assurance that if any of the conditions <br />set forth in Section l~.3 (5) of Ordinance 6i~ occur at <br />some time in the future, the Village Council will allow <br />the structure to be rebuilt, thus re-establishing a <br />non-conforming use in the '~R-3~~ district. <br />NOW, THEREFORE, it is hereby resolved by the Village <br />Council of the Falcon Heights as follows: <br />1. In the event that at some future time, any of <br />the conditions set forth in Section 1t.3 (5) <br />of the Ordinance btu occur to what is now the <br />Lindig greenhouse, the Village Council of <br />Falcon Heights now gives every reasonable <br />assurance that favorable consideration will be <br />given to the buyer of said property in his <br />application for a conditional use permit, so <br />that the business may be continued to the same <br />extent as prior to the destruction of the <br />premises. <br />The motion for adoption of the foregoing resolution was duly <br />seconded by Councilman Black and upon a vote being taken <br />thereon, the following voted in favor thereof: Mayor <br />Warkentien, Councilmen Black, Ecklund, and Councilwoman <br />Stocker, and the following voted against: Councilman Stone. <br />Whereupon said resolution was declared duly passed and <br />adopted. <br />Opticom Device: Attorney Kenefick presented some information on the Opticom <br />Device, a device which is used to change traffic lights for <br />fire and amergency vehicles when they are on an amergency <br />call, and which would be funded by Ramsey County. He also <br />stated that the City of St. Paul would like the Village to <br />pass an ordinance prohibiting the use of this device on <br />unauthorized vehicles. The matter was tabled until the <br />Attorney can procure more information on this device. <br />Corporate Licenses; Councilman Black moved, seconded by Mayor Warkentien, to grant <br />U of M Forestry the University of Minnesota Forestry Club, a corporate license <br />Club: to sell Christmas trees at the Gibbs Farm, for the 1972 <br />season. Motion carried. <br />Bertel Gimmestad: Councilwoman Stocker moved, seconded by Councilman Stone, <br />to approve the application for a corporate license`tcr~se`il <br />Christmas trees at 1871 W. Larpenteur Avenue, by Mr. Bertel <br />Gimmestad, 19t~8 North Prior Avenue. Motion carried. <br />Temporary Garage <br />Conditioaal Use <br />Request: <br />Mrs. Grace Wu, 1395 W. Idaho, requested a conditional use <br />permit to construct a temporary garage at the above address <br />for the winter months. It was suggested that the request <br />go before the Planning Commission and the Village Engineer <br />for their approval. <br />
