191l~ <br />SPEC TAL ~'f~ETING RAY 15 , 1963 <br />The special meeting was called to order at 8:00 P.tri. with the follawing <br />members being present: Harold C. Nilsen, Idayor; George Shavor, Trustee;. <br />Wi11is Warkentien, Trustee; Charles Stone, Trustee; W. A. A~ortenson, <br />Clerk. Also present were: Brad Lemberg, Village Engineer and 1~~iichael <br />Galvin, Village Attorney. <br />The minutes of the previous meeting were read and approved as read. <br />Roberts Apartment I~r. Roberts was present with his attorney, John Daubney. <br />Permit Requests Interested residents included ~~r. and hrs. Hustrulid, <br />R?r. Bianchi, and lt~r. and dirs. Anderson, all of Fairview <br />Avenue. <br />~.ir. Daubney presented copies of the revised plan for <br />the Roberts apartment project, with an ou~tl.ine of the <br />project to consist of lb single bedroom apartments. <br />Lemberg reported that he had checked the plan and <br />that it complied with the regulations for parking and <br />set backs and illustrated the improved effect of angle <br />P~'• <br />The Clerk read a letter from the Village Attorney <br />reviearing the application for the building permit, <br />citing applicable ordinances regarding parking space, <br />side yards, bumper curbs and fencing, and screening <br />and fencing around off-street parking area. Re- <br />strictive covenants in deeds on lot lines and. set <br />backs on other Fairview Avenue lots did not apply to <br />this property. To enforce a 50 ft. set back along <br />the Fairview Avenue side of the Roberts Construction <br />Company lot would present a grave constitutional <br />question. <br />~~fir. Hustrulid thought statements made in the minutes <br />of the December 21st, 1961 hearing should be entered <br />here in reference to the 50 ft. set back. <br />Shavor referred to the 100 ft. distance from the back <br />of the apartment to the end of the lot gave good <br />protection to the other properties, and that the plan <br />seemed to be a good one. Hustrulid felt the automobile <br />traffic would create a problem. <br />Nilsen recited the extent of the study made to be fair <br />with the property owners. <br />Daubney referred to the filling station application <br />that was withdrawn due to objection of Fairvi~+r res- <br />idents and changed their application to an apartment <br />for which the land was properly zoned now and when <br />the land was first purchased. <br />
