2158 <br />The following resolution was introduced by Stone, who <br />moved its adoption: <br />WaterMain and RESOLUTION ADOM'TT~1G ASSESSMENT FOR WATER MAIN <br />Sanitary Sewer TI~4PROVER'~NT OF 1963 ON PROPERTY OWNED BY THE <br />Improvement UNIVERSITY OF ",MINNESOTA ~FtITHIN THE VILLAGE <br />1963 -.Assessment OF FALCON HEIC~iTS, MINNESOTA <br />on Property <br />Owned by Univ, WHEREAS the laws of Minnesota, Chapter u35.19 provide <br />of Minnesota: for the method of assessing special assessments against <br />property owned by the University of :!innesota and benefited <br />by such improvement, and <br />ti~fiEREAS theVillage Council of the Village of Falcon <br />Heights has met pursuant to proper notice duly given as <br />required by law, and <br />VVti1HHEREAS the Council has met and heard and passed upon <br />all objections to the proposed assessment for said <br />improvement, <br />NOt~, THEREFORE, BE IT RESOLVED BY THE VILLAGE COIIfNCIL <br />OF FALCON HEIGHTS, P1IINi~OTA: <br />1. Such proposed assessment, a copy of which is <br />attached hereto, is the amount that would have been <br />assessed against said property if the property had been <br />privately awned. Said assessment is hereby accepted and <br />shall constitute the special assessment against the lands <br />named therein and each tract of land therein included is <br />hereby found to be benefited by the proposed assessment <br />in the amount of the assessment levied against it. <br />2. Such assessment shall be payable in e~}ual annual <br />installments extending over a period of twenty years, the <br />first of the installments to be payable on or before the <br />first P~ionday in January, 1965, and shall bear interest at <br />the rate of b~ per annum from the date of the adoption of <br />this assessment resolution. To the first installment shall <br />be added interest on the entire assessment from the date <br />of this resolution until December 31, 1965. To each sub- <br />sequent instal lment, when due, shall be added interest for <br />one year on all unpaid installments. <br />3. The ov~mer of any property so assessed may at any <br />time prior to the certification of the assessment to the <br />county auditor, pay the whole of the assessment on such <br />property, tivith interest accrued to the date of the payment, <br />to the village treasurer, except that no interest shall <br />be charged if the entire assessment is .paid within 30 days <br />from the adoption of t?~is resolution; and he may, at any <br />time thereafter, pay to the county treasurer the entire <br />amount of the assessment remaining unpaid with interest, <br />accrued to December 31, of the year in which payment is made. <br />~.. The Clerk shall forth~rith transmit a certified <br />duplicate of t~~is assessment to the county auditor to be <br />extended on the proper tax lists of the county and such <br />assessment shall be collected and paid over in the same <br />manner as other municipal taxes. <br />
