2221 <br />the Village Council of Falcon Heights in accordance <br />RESOLUTION with the Certificate of Survey of Milner W. Carley <br />Approving Sub- and Associates dated February 24, 1965 submitted to <br />division of Lands said Council and on file with the Clerk thereof, <br />subject to the followings <br />2. At the time of the conveyance of the sub- <br />divided lot to purchasers, George Gasparro or his <br />successor in interest shall create a five foot wide <br />easement over the westerly five feet of property <br />line of the new lot, all as shown on the above- <br />referred to survey. This is for utility purposes and <br />drainage as necessary on the back lot line. <br />3. The proposed easements shall be created by <br />such instruments suitable for recording to be prepared <br />by the Village Attorney. <br />The motion for the adoption of the foregoing resolution <br />was duly seconded by Stone and upon a vote being taken <br />thereon, the following voted in favor thereofs Nilsen, <br />Warkentien, Stone and Black whereupon said resolution was <br />duly declared passed and adopted. <br />Variance application The variance application submitted by Arthur Jorgenson <br />Submitted by Arthur under date of February 5, 1965 was deemed unnecessary <br />Jurgensons and Nilsen moved that the V3.].]_age Clerk be instructed <br />to return the fee of X5.00 which Jorgenson had paid. <br />Motion seconded by Warkentien and carried. <br />Proposed Apartm®nt <br />Buildings - Killmer's Black introduced the following resolution and moved <br />Nurseries Property its adoptions <br />1700 West Larpenteurs WHEREAS, Clarence Lowe and H. Goeman have made an <br />application for variance and conditional use and filed <br />the same with the Village of Falcon Heights along with <br />the fee of X10.00, and <br />WHEREAS, the matter has been referred to the <br />Planning Commission for the Village of Falcon Heights, <br />and <br />WHEREAS, the Planning Commission has recommended <br />that said application would be approved if the number <br />of feet at the rear of the building or the south end of <br />the property were made to conform to Ordinance 6~. with <br />respect to the possible extension of Hoyt Avenue, <br />NOW, THEREFORE, BE IT RESOLVED that Clarence Lowe <br />arld H. Goeman withdraw said variance and conditional <br />use app3i3.~ation submitted at this time and submit <br />new applications when plans have been revised. <br />Motion for the adoption of the foregoing resolution was <br />1 <br />J <br />I <br />
