2302 <br />Reassessing Lot 13, WHEREAS, on August 15, 1957, the Village Council by <br />Block 1, Barthel resolution unanimously adopted the assessment roll for <br />Villas Addition - Sanitary .Sewer System Tmprovement No.l which was there- <br />Sanitary Sewer after certified to the County Auditor and extended on the <br />System Improvement proper tax lists of the county, and <br />No. 1 (1957) <br />WHEREAS, the said assessment roll, showed Lot 13, <br />Block 1, Barthel Villas Addition to have an assessable <br />frontage of 75 feet for which an assessment of $672.00 <br />tier lot was made, and <br />WHEREAS, since the incorporation of the Village a <br />building permit has been refused on that lot because it <br />was a low lot and the erection of a building upon it woulc <br />interfere with natural drainage, and, <br />WHEREAS, the owner of that lot requested that the Sar. <br /> nary Sewer System Improvement No. 1 assessment on that <br /> lot be removed until such time as the Village Council <br /> will authorize issuance of a building permit on that <br /> lot when the assessment would be reinstated, and <br /> WHEREAS, on February 26, 1959, the Village Council <br /> by Resolution reassessed Lot 13, Block 1, Barthel Villas <br /> and removed said assessment pursuant to M.S.A. 1129.071 <br /> because said assessment was e$cessive in view of the <br /> fact that the Village had permitted no use of said lot, <br /> and <br /> WHEREAS, subsequent to said reassessment of Lot 13, <br /> Block 1, Barthel Villas, the Village grant the owner <br /> of a building permit for said lot, and a bu lding has <br /> since been erected thereon, <br /> NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE <br /> Council of the Village of Falcon Heights, Minnesotan <br />(1) The assessment originally adopted August 15, <br />1957 by the Village Council in the amount of $672.00 <br />for the Sanitary Sewer System Improvement No. 1 is <br />hereby reassessed and shall constitute the special <br />assessment against Lot 13, Block 1, Barthel Villas, and <br />said lot is found to be benefited by the proposed <br />improvement in said amount. <br />(2) Such assessment shall be payable in equal <br />annual installments to be payable over a period of 12 <br />years, the first of the installments to be payable on <br />the first Monday in January, 1966 and shall bear interest <br />at the rate of ~~ per annum from the date of the adoption <br />of this resolution. To the first installment shall be <br />added interest on the entire assessment from. the date of <br />this resolution.
