<br />The meeting was called to order at 7 P. P,2., the follow~.ng Council Members being
<br />present: Harold C. Nilsen, Mayor; George J. Shavor, Trustee; YFillis Warkentien,
<br />Trustee and Paul Coppini, Trustee. Also present were Frank N. Graham, Village
<br />Attorney; Wm. E, Olsen, Treasurer; Nick Christensen, Building Inspector; Vern
<br />Ljungren, ~,iillage Engineer; Don Arndt, Public Safety Commissioner and Ethel E~

<br />The minutes of the regular meeting of February 11th were approved as s»bm~ttPd
<br />Barthel i~4ayor Nilsen read the Affidavit of Publication of the J~egal Notice
<br />Villas of Hearing on ?'roposed Feassessment for Sanitary Sewer System Im-
<br />provement Pdo. 1 of unimproved property located on Pascal and Holton
<br />Avenues between Garden and Holton described as lots 13s 1~~, 15, 20
<br />'n^ 21, Block. 1, Barthel Villas Addition, as published in the Rose
<br />Tribune January 29th and February 5th 195°.
<br />Attc~rraey Graham summarized the situation explaining that the Village
<br />has '??~ .^ St?"'~'"'»~^ ^rder not to issue building permits for these }~,~ .w~¢c1J
<br />lots because it vrould interfere with the natural drainage. It ~ _.__..
<br />appeared, after the assessment was put on, that the owners of the
<br />lots objected to the assessments until such time as building permits
<br />could be issued. The Village Council has the power to re-assess if
<br />they find the original assessment is too high.
<br />Attorney James F. Greenstein appeared on behalf of. the o~~;ners of the
<br />property. He Gtated he did not feel this is the solution to their
<br />problem, but it is a better situation than they have at present.
<br />They s+ill have to pa.y taxes and c~:,znot use the property. Tars.
<br />Barthel, vrho is the o~~~rner of most of the property, and har aughter,
<br />~T-rs, Roberts, were present.
<br />Sha~ror asked if the reinstatement of the assessment could be hane~led
<br />individually if and when the Village could permit building on certain
<br />parcels. Attorney Graham advised that it could be handled in this
<br />manner.
<br />After discussion, Coppini moved the adoption of the follov~ing resolu-
<br />tion.
<br />RESOLU'"ION REASSESSING LOTS 13, l~, 15,
<br />20, and 21, Block 1, Barthel Villas Add-
<br />ition for Sanitary Sewer System Improvement
<br />No. 1.
<br />V,HEREAS, on August 15th, 1957, the Villag® Council by resolu-
<br />tion unanimously 4dopted the assessment roll for Sanitary Sewer
<br />System Improvement Aio. 1 which was thereafter certified to the
<br />County Auditor and extended or_ the groper tax lists of the County; and
<br />VtiKEFtEAS, the said. assess~ac;;~± roll showed Lots 13, l~ , 15, 20 and
<br />21, Block 1, Barthel Villas Addition to have an assessable frontage of
<br />75 feet for which an assessment of X672.00 per lot was made; and
<br />'pd'HEREAS, since the incorporation of the Village Building permits
<br />have been refused on these lots because they are long lots and the
<br />erection of buildings upon them would interfere with the natural
<br />drainage; and
<br />Vv'HEREAS, the otiti~ners of these lots have requested that the 5an-
