~~~~ <br />nary Sewer System Improvement No. 1 assessment on these <br />lots be removed until such time as the Village Council will <br />authorize issuance of building hermits on these lots when <br />the assessments would be -reinstated; and <br />~1HEREAS, Section 1}29.071 of the Pdinnesota Statutes per- <br />mits a reassessment to be made where the Council finds that <br />the original assessment is excessive, upon notice and hearing <br />as provided for in the original assessment; and <br />~dHER~45, notice of hearing on tJzis proposed reassessment <br />was published in the Rose Tribune on January ?_9th and February <br />5, 1959 as provided for in the original assessment; <br />NOVA THEREFORE, ~3L yT RESOLVED by the Village Council of <br />the Village of Falcon Heights, Pu7innesota: <br />1. The Village Council finds that the original Sanitary <br />Sewer System Improvement No. 1 assessments of "672.00 per lot <br />for lots 13, 1.-~, 15, 20 and 21, Block 1, F3arthel Villas Addi- <br />tion ~nTere and are excessive considering that the Village re- <br />fuses to issue building permits on these lots, and each of <br />said lots is hereby found to have no benefit from the said im- <br />pro~rement at the present time. <br />2. Upon reassessment, the Council finds that the assess- <br />meat roll for Sanitary Sewer System Improvement No. 1 a~>-G~roved <br />by this Council on August 15, 1957 with respect to lots 13, l.l.t, <br />15, 20 and 21, 31ock 1, L:~.rthel Villas Addition, should be <br />changed and these lots a,re reassessed to sY~ow no benefits tc <br />these lots and no assessments against the lots upon the under- <br />standing th?t when the Village Cc~~~° ^il TRrill authorize i stiua~~cQ <br />u '.,~il_-?inf_ ror-nits on these lots the original assessments <br />will be reinstated upon notice and hearing. <br />3. lei,, village Clerk is hereb;~ authorized and directed <br />to prepare a certified copy of this resolutio,~ and to deliver <br />rh„ sane to the County Auditor of Ramsey County and to do any <br />and a.11 things necessary to see that the reassessment ,~' lots <br />13, l~, 15, 20, and 21, Block 1, .Barthel Villas Addition herein <br />made, is entared upon the necessary books and records of the <br />County ~.uditor. <br />The motion for the adoption of the foregoing resolution eras <br />seconded. by Shaver and unanimously carried, <br />Rezoning LeRoy Jackson, 1609 Tliles Avenue, St. Paul, owner of tha 50' <br />lot on the S. ~"~. corner of Larpenteur and Pascal appeared be- <br />fore the Council to ask rezoning of >>roperty in question to <br />Hermit the building of a duplex er ~-plex. He was advised tYiis <br />property was already zoned "Residential District C" which ti~ould <br />.~.:i.nit this use but that the Council had been advised that there <br />eras a deed restriction on the property which would not permit <br />multiple dwellings. He was advised r.e vrould have to get the <br />deed restriction released by the benefited property owners be- <br />fore the Council could issue a Hermit for a multiple dwelling. <br />
