Bell Telephone, bill due 7/10 111.28 <br />Lindig- Mayor Nilsen opened the hearing saying a matter that is on the <br />Spiegler agenda before the Council this evening has been the sub3ect of <br />Building very intensive and exhaustive study for the past seven months. <br />Permits It has been gone into carefully and considerately by the members <br />of the planning commission and by other elected officials of the <br />village council. <br />During that time, the council has sought, and has been given the <br />facts and the expert opinion of a planning authority whose back- <br />ground, professional ability and integrity is respected by hose <br />in his field, and by those official bodies of other communities <br />for whom he has done planning work. This man, in his report, <br />provided an ob3ective and informed point of view in covering all <br />points of debate. <br />The Village Council faces many problems in it's deliberations, and <br />I would say this to the people of Falcon Heights -that you expect <br />us to face them with honesty and courage, to fully investigate, <br />and to make a decision in the public interest. <br />I commend to you the decision of the court, and ask that I be per- <br />mitted to leave a thought with you. <br />Samuel Johnson once said: "The law is the last result of human <br />wisdom acting upon human experience for the benefit of the public." <br />attorney Graham summarized previous proceedings by saying. the <br />Court filed a Memorandum Decision dated July 8th, 1959, in which the <br />Court stated it concluded that Ordinance No. 8 was not unconstitu- <br />tional as it applied to the Wm. Lindig property. The Court would <br />take no action on the Mandamus question at present and the Council <br />would have a period of ten days after the filing to take action. <br />The Findings of Fact were prepared, they were filed Monday, the 20th, <br />Judgment was entered that day and it is up to the Council to take <br />action on the Spiegler permit, The Judge didn't tell the Council <br />what to do. <br />Utecht read the summary of recommendations prepared by Dahlgren, <br />
