15.5 <br />SPECIAL ~aEETING DECET.?BER 29th, 1960. <br />;ieeting was called to order at 7:10 P. M., the following Council P~Zembers being <br />present: Harold C. Nilsen, P~4ayor; ~"Jm. R. Utecht, Clerk; Paul L. Coppini, <br />Trustee; George Shavor, Trustee and ~i~Tillis '~";arkentien, Trustee. Also present <br />were Frank N. Graham, Village Attorney; Wm. E. Olsen., Treasurer; Vd. A. Pdortenson, <br />Clerk Elect; and Ethel E. Udhite, Deputy Clerk a.nd Deputy Treasurer. <br />The T?inutes of December 19th were approved as submitted. <br />Hearing At 7;10 P. T:4., :Zayor Nilsen opened the meeting to pass upon <br />Falcon Hgts. a proposed reassessment for watermain improvement of 1960, <br />Church: No. 1, of unimproved property located on Holton Avenue <br />between Garden and Roselawn described as Lot 19, Block 1, <br />Barthel Villas Addition, by reading copies of Notice as <br />Hosted and published. He then asked if there were any <br />objectors. There being none, Utecht moved adoption of the <br />following resolution: <br />RESOLUTION REASSESSING LOT 19, <br />BLOCK 1, BARTHEL VILLAS ADDITION <br />FOR WATERMAIN IMPROVEMENT OF 1960, <br />N0. 1. <br />TrtHEREAS, on October 17, 1960, the Village Council b.y <br />resolution unanimously adopted the assessment roll for Water- <br />main Improvement of 1960, No. 1 which was thereafter certified <br />to the County Auditor and extended on the proper tax lists of <br />the county; and <br />WHEREAS, the said assessment roll, showed Lot 19, <br />Block 1, Barthel Villas Addition to have an assessable <br />frontage of 75 feet for vahich an assessment of $551.25 was <br />made; and <br />~1HEREAS, since the incorporation of the Village, a <br />building .permit has been refused on this lot because it is <br />a low lot and the erection of buildings upon it would inter- <br />fere with natural drainage; and <br />WHEREAS, the owner of this lot has requested that <br />'vJatermain Improvement of 1960, No. 1 assessment on this lot <br />be removed until such time as the Village Council will <br />authorize issuance of a building permit on this lot when <br />the assessment would be reinstated; and <br />WHEREAS, Section ~I-29.071 of the 1`iinnesota Statutes <br />permits a reassessment to be made where the Council finds <br />that the original assessment is excessive, upon notice and <br />hearing as provided for in the original assessment; and <br />ti~JHEREAS, notice of hearing on this proposed reassess- <br />ment was published in the Rose Tribune on December 15, 1960 <br />as provided for in the original assessment; <br />
