Community means the City of Falcon Heights except as otherwise indicated.
<br />Comprehensive municipal plan means the policies, statements, goals, and interrelated plans
<br />for private and public land and water use, transportation and community facilities, including
<br />recommendations for planned execution, documented in texts, ordinance, code and maps, which
<br />constitute the guide for the future development of the community or any portion of community,
<br />as on file with the city planning commission. This shall include the city comprehensive plan and
<br />all subsequent amendments, additions, and elements developed as per requirements of the
<br />Metropolitan Land Planning Act (Minn. Stats. §§ 473.851—473.871)
<br />Computer programming, and data processing services means establishments primarily
<br />engaged in providing computer programming and data preparation and processing services.
<br />Establishments of this industry perform a variety of additional services, such as computer
<br />software design and analysis; modifications of custom software; and training in the use of
<br />custom software. Also included are application software programming, computer code authors,
<br />computer programs or systems software development (custom), computer software writers
<br />(freelance), software programming, calculating service, computer time-sharing, data entry, data
<br />processing, data verification, keypunch, leasing of computer time, optional scanning, rental of
<br />computer time, service bureaus (computer), and tabulating.
<br />Conditional use means a use which is generally appropriate in a specified zoning district but
<br />requires special planning considerations and, in certain instances, unusual and extraordinary
<br />limitations peculiar to the use for the protection of the public health, safety and welfare or the
<br />integrity of the Falcon Heights comprehensive plan.
<br />Condominium. See Dwelling, multiple or apartment building.
<br />Convenience store means a retail establishment that generally sells a limited range of food
<br />products, nonprescription drugs, candy and other perishable goods. This includes soda and
<br />similar beverage dispensing and food products, which can be heated and/or prepared on site.
<br />Council means the governing body of the City of Falcon Heights, Minnesota.
<br /> Curb level means the grade elevation of the curb in front of the center of the building. Where no
<br />curb has been established, the city engineer shall determine a curb level or its equivalent for the
<br />purpose of this chapter.
<br />Dance studios, schools and halls means establishments primarily engaged in operating
<br />dance studios, schools, and public halls or ballrooms.
<br />Depth of lot means the horizontal distance between the frontage right-of-way line and rear
<br />lot line. On a corner lot, the side with the largest frontage is its depth, and the side with the lesser
<br />frontage is its width.
<br />Depth of rear yard means the horizontal distance between the rear building line and the rear
<br />lot line.
<br />Development means any manmade change to real estate, including but not limited to
<br />construction or reconstruction of buildings, installing manufactured homes or travel trailers,
<br />installing utilities, construction of roads or bridges, erection of levees, walls, or fences, drilling,
<br />mining, filling, dredging, and storage of materials.
<br />Disposal area, on-site sewage treatment means that ground within the confines of the lot
<br />that does not contain buildings and has an elevation of at least 80 inches above the highest
<br />known or calculated water table or bedrock formation; does not slope in excess of 13 percent;
<br />and meets the requirements of permeability as determined by the rate of water percolation in the
