MINUTES <br />REGULAR CITY COUNCIL MEETING <br />FEBRUARY 25, 1987 <br />Baldwin opened the meeting at 7:00 P.M. <br />ALL MEMBERS PRESENT <br />Baldwin, Ciernia, Chenoweth, Wallin, and Hard. Also present were Barnes <br />and Schroeder. <br />CONSENT AGENDA APPROVED <br />Chenoweth moved, seconded by Wallin, approval of the Consent Agenda. <br />Motion carried unanimously. <br />MINUTES OF FEBRUARY 11, 1987 APPROVED <br />Ciernia moved, seconded by Wallin, approval of the Minutes of February 11, <br />1987. Motion carried unanimously. <br />DISCUSSION OF PROPOSED CONTRACT COMPLIANCE ORDINANCE <br />Schroeder reviewed and explained his updated draft of the proposed <br />ordinance which is based on the document drafted by the City Human Rights <br />Commission. The item was interrupted to allow for the public hearing <br />scheduled for 7:15 P.M. <br />7:15 P.M. - PUBLIC HEARING ON PROPOSED VEHICLE REPAIR CODE AMENDMENT <br />OPENED AND CONTINUED TO 8:00 P.M. <br />Baldwin opened the public hearing at 7:15 P.M. and presented the Affidavit <br />of Publication, after which Hard moved, seconded by Wallin, continuing the <br />hearing to 8:00 P.M. to allow time to continue discussion of the contract <br />compliance discussion. Motion carried unanimously. <br />CONTRACT COMPLIANCE DISCUSSION RESUMED <br />Schroeder commented on incorporating a reporting system for companies <br />contracting with the City, means of enforcement, provision for due <br />process, and whether or not the document should be limited to contract <br />compliance or be extended to housing, etc. The item was interrupted to <br />allow for the public hearing scheduled for 7:30 P.M. <br />7:30 P.M. - PUBLIC HEARING ON SUBDIVISION REQUEST FROM GEORGE W. NIELSEN, <br />1795 FRY ST. <br />Baldwin opened the public hearing at 7:30 P.M., and presented the <br />Aff idav it of Publication. Wallin expressed concern that the latest survey <br />does not show the existing utility easement and felt it possible that some <br />future purchaser of the lot might not be aware of the underground <br />utilities. Mr. Nielsen explained the utilities will be moved to their own <br />lot when Lot A is sold, however, he was willing to have the survey amended <br />to show the existing utility easement. Other concerns discussed by <br />Council were maintenance of the private utilities and driveway, possible <br />traffic hazards with three households using one access to Fry Street, the <br />advisability of increasing the driveway width to 20 feet, and whether or <br />not the driveway should be designated an alley. Baldwin was concerned <br />that by allowing these homes on a driveway with one exit to the street it <br />would set a precedent especially in relation to possible construction on <br />the newly subdivided lots at the end of Lindig. <br />~~ <br />
