MINUTES <br />REGULAR CITY COUNCIL MEETING <br />FEBRUARY 25, 1987 <br />PAGE 2 <br />There being no others wishing to be heard, Baldwin closed the hearing at <br />8:04 P.M., after which Wallin moved, seconded by Chenoweth, adoption of <br />Resolution R-87-12 with the following contingencies: (1) identification <br />of existing utilities on survey, and (2) a document establishing a <br />covenant relating to the maintenance of the private driveway and <br />utilities, such document to run with the land. Upon a vote being taken <br />the following voted in favor thereof: Baldwin, Ciernia, Chenoweth, and <br />Wallin, and the following voted against the same: Hard. Motion carried. <br />RESOLUTION R-87-12 <br />A RESOLUTION RELATING TO THE APPROVAL OF A REQUEST <br />FROM GEORGE W. NIELSEN, 1795 FRY STREET, FOR SUBDIVISION <br />OF HIS PROPERTY <br />CONTINUATION OF HEARING ON CODE AMENDMENT RELATING TO PRIVATE VEHICLE <br />REPAIR <br />At 8:05 P.M. Baldwin resumed the hearing on private vehicle repair, and <br />there being no one wishing to be heard, closed the hearing at 8:07 P.M. <br />Hard moved, seconded by Wallin adoption of Ordinance No. 0-87-1 with <br />corrections as recommended by the Planning Commission, and authorization <br />to publish the same. Motion carried unanimously. <br />ORDINANCE 0-87-1 <br />AN ORDINANCE AMENDING SECTIONS 9-1.02 SUBDIVISION <br />2(14), 9-1.02, SUBDIVISION 2(70), 9-1.02, SUBDISION <br />2(71), 9-10.01, SUBDIVISION 2(f) AND ADDING SECTIONS <br />9-4.01, SUBDIVISION 3(i) AND 9-13.07 AND ITS SUBDIVISIONS <br />TO THE MUNICIPAL CODE FOR THE CITY OF FALCON HEIGHTS RE- <br />LATING TO PRIVATE AUTOMOBILE REPAIRS <br />CONTRACT COMPLIANCE DISCUSSION RESUMED - DEFERRED TO 3/25/87 <br />Council discussed whether or not it is necessary to have an ordinance <br />extending beyond State Statute, the City's exposure to law suits, <br />problems with enforcement (need for persons with expertise in the field), <br />and possibility of limiting application of the ordinance to firms based on <br />a dollar amount of the project or service, or number of employees. Wallin <br />suggested that if the City does proceed with the adoption of such an <br />ordinance, it be limited to classes presently protected under State <br />Statute to limit the City's liability, and Council concurred. Schroeder <br />was directed to; (1) obtain information on experience encountered by St. <br />Paul and Minneapolis (both communities presently have compliance <br />ordinances), (2) obtain any information the League of Cities may have on <br />the subject, and (3) make recommendations regarding limiting language and <br />enforcement. The matter will be discussed further at the March 25th <br />meeting. <br />SNELLING AVENUE TO BE UNDER CONSTRUCTION 6:00 A.M. TO 10:00 P.M. <br />Council discussed the fact that the contractor reconstructing Snelling <br />Avenue has indicated the crews will be working long hours and this may <br />violate the nuisance portion of the City Code.
