~V <br />MINUTES <br />MAY 11, 1988 <br />PAGE 2 <br />• discussed the request from James Frisell, 1953 Summer, to expand <br />his present one car two garage into a two car garage <br />necessitating a ten foot encroachment into the thirty foot <br />setback, and had unanimously recommended approval. Wallin moved <br />approval of the variance based on the following findings: 1) <br />unique shape of the lot and placement of the house on such lot, <br />and (2) it would deny the owner a substantial property right as <br />it is the only way it would be possible for the garage <br />expansion. Motion carried unanimously. <br />ASSESSMENT AGREEMENT WITH BRODY ASSOCIATES (FOR CIATTI'S <br />RESTAURANT PARKING) <br />Gedde informed Council that Brody Associates had signed the <br />assessment agreement relating to construction of additional <br />parking on the City right-of-way near Ciatti's Restaurant, and <br />that Ciatti's have no objection to the agreement, but did <br />request two slight alterations to the parking plan, ie; change <br />stalls one through nine to eight feet for compact cars, and sign <br />the area "3 Hour Parking". Council agreed to the changes. The <br />discussion was interrupted for a public hearing scheduled for <br />7:15 P.M. <br />7:15 P.M. - PUBLIC HEARING ON AMENDMENT OF SECTION 9-15.04 OF <br />THE CODE RELATING TO CONDITIONAL USES <br />• Baldwin opened the public hearing and presented the Affidavit of <br />Publication. Gedde explained the proposed amendment will bring <br />the City Code into compliance with State Statutes by including <br />detailed standards to be followed by the Planning Commission and <br />Council for conditional use requests. He stressed that when <br />conditional uses are granted findings based on the criteria <br />listed in the code should be stated. <br />There being no one in attendance wishing to be heard, Baldwin <br />closed the public hearing at 7:22 P.M., and Wallin moved <br />adoption of Ordinance No. 0-88-10. Motion carried unanimously. <br />ORDINANCE 0-88-10 <br />AN ORDINANCE AMENDING CHAPTER 9, PART 9-15.04 <br />OF THE CODE OF THE CITY OF FALCON HEIGHTS RELATING <br />TO CONDITIONAL USES <br />ASSESSMENT AGREEMENT WITH BRODY ASSOCIATES APPROVED <br />After a brief discussion, Ciernia moved approval of the <br />assessment agreement between Brody Restaurant Associates and the <br />City. Motion carried unanimously. <br />DISCUSSION - "NO PARKING" ON BOTH SIDES OF ST.
