Baldwin suggested it <br />might be appropriate to deal with Mr. Hunt's attorney or realtor <br />if the matter is misunderstood by Hunt. <br />PROPOSED CHARITABLE GAMBLING ORDINANCE DISCUSSION <br /> <br />Wiessner recommended that Council take immediate action on <br />charitable gambling as the City's present code is in conflict <br />with State Statute and, therefore, null and void. This could <br />allow the State to grant a license to a group which has applied <br />for a license to sell pull tabs in Falcon Heights (Charity Bowl) <br />with no City input. The following options were presented: (1) <br />do nothing and allow the State to regulate charitable gambling <br />in the City, (2) adopt an ordinance stip ulating the City's <br />involvement, or (3) adopt an ordinance prohibiting all <br />charitable gambling. Council agreed Option 1 was not <br />acceptable, and proceeded to review and revise the proposed <br />ordinance prepared by the City Attorney. After discussing <br />possible methods by which the City might restrict charitable <br />gambling, Council agreed more time was needed to make an <br />informed decision. Wallin then moved adoption of Ordinance <br />0-88-1 which would prohibit charitable gambling in the City. <br />Motion carried unanimously. Wallin explained that he was not <br />opposed to the idea of charitable gambling, but felt more time <br />was needed study the issue. <br />ORDINANCE 0-$9-1 <br />AN ORDINANCE AMENDING CHAPTER 5, PART 15 <br />OF THE CODE OF THE CITY OF FALCON HEIGHTS <br />r~ <br />MORE INFORMATION TO BE OBTAINED ON CHARITABLE GAMBLING AND <br />PROPOSED ORDINANCE TO BE RE-DRAFTED <br />Staff was directed to obtain further information from the City <br />Attorney and neighboring communities regarding whether or not <br />charitable gambling could be controlled as a conditional use, if <br />the number of licenses could be restricted, if licenses could be <br />restricted to local organizations only, and if the City has any <br />mechanism by which the State could be required to act upon <br />licensees which the City may determine to be dissatisfactory. <br />The proposed ordinance will then be redrafted for future <br />consideration. <br />WATER UTILITY TO INST ALL REMOTE METERING SYSTEM <br />Wiessner presented an contract agreement proposed by the St. <br />Paul Water Utility which would allow the Water Utility to <br />install remote metering systems in Falcon Heights. Following a <br />brief discussion, P. Chenoweth moved approval of the contract <br />which carried unanimously. <br />APPROVAL OF REQUEST FOR REFUND ON CANCELLED PIZZA HUT BUILDING <br />PERMIT <br />Baldwin explained that a proposed Pizza Hut addition was <br />cancelled due to the possibility that the structure might be <br />~~ <br />
