X27 <br />Meeting of October 10, 1956, reconvened at 7:35 PM, October 15, 1956, the following <br />council members being present: William R. Utecht, Mayor; George J. Shavor, Trustee; <br />David P. Cartwright, Trustee; Clyde J. Stewart, Clerk. Also present: YVilliam E. <br />Olsen, Treasurer, and Frank N. Graham, Attorney. <br />Tank truck Mayor Utecht reported on contacting Mayor Kitts of Roseville <br />& mutual about the proposed meeting with representatives of our <br />aid - meeting council and Fire Chief Grumke on mutual aid matters, and <br />with Roseville that Roseville is agreeable to the meeting at a time to be <br />set by Mayor Kitts. <br />Associated Investors Shavor reported on discussing with Don Julen a number of <br />vacant property times the requirements to.be met by the owners of the property <br />west of Arona and. south of the business district. Shavor <br />said he was informed by Julen that (1) grading and. sodding <br />would be completed as soon as more soil which had been arranged <br />f.or could be hauled in (2) that plans are to put the catch <br />basin in and. some plantings this fall (3) that the water way <br />on the south side and planting strip are established but have <br />to be finished and shrubs put in. Only thing not agreed on, <br />Shavor said, is the recordable agreement as to maintenance of <br />grass and plantings which would involve title to the land. <br />Shavor recommended holding the matter over until our October 24, <br />1956 meeting, After discussion, it was agreed that in lieu of <br />a recordable agreement that our attorney should condition the <br />proposed rezoning on the property owners' sodding and maintenance <br />of the area. <br />Complaints re The lUiayor reported on complaints received regarding the <br />Shell Oil Station Shell Oil Station operating until midnight, that neighbors <br />report that the station seldom closes on time and that work <br />is done in the back of the station after hours. On motion <br />by Utecht, seconded by Cartwright, the following resolution <br />was adopted by a unanimous vote: <br />Resolution - WHEE.EAS, the council has had many complaints with respect <br />to noise and. late operation at the Shell Gasoline Station <br />located at 1l~07 Larpenteur Avenue West; <br />NOW THEREFORE, BE IT RESOLVED, under Section IV of Ordinance <br />No. 27, that the license heretofore granted to Carroll J. <br />Nelson, .Shell Oil Company, to operate a filling station at <br />1l~07 Larpenteur Avenue uVest be, and it is, hereby expressly <br />conditioned upon the limitation that the station will be <br />closed and all operations upon the premises shall cease at <br />10:00 P.M.-each day, and that the station shall not be opened <br />nor any operations conducted on the premises before 7:00 A.M. <br />on any day. <br />RESOLVED FURTHER, that the Clerk write a letter to the <br />operator advising him of the passage of this re¢lso~ution and <br />informing .him that if the provisions of this resolution are <br />violated, steps will be taken under Section IV of Ordinance <br />No. 27 to revoke the said license. <br />Leroy D. Humphrey Account Officer Earl Smith being hospitalized for several <br />employed as part weeks, Cartwright moved that Leroy D.Humphrey,.19l~0 Nebraska, <br />time police officer St Paul, be employed to take over the duties of police officer <br />relieving Earl Smith, Earl Smith during the latter's disability, at the same rate <br />injured. of pay, and that the Clerk confirm this by letter. Utecht <br />seconded and motion carried unanimously. <br /> <br />
