o~~ <br />REGULAR MEETING, THURSDAY, MARCH 11t, 1957 <br />Meeting called to order at 7:30 P. M., the following council members being present: <br />William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee; <br />Willis Warkentien, Trustee; Clyde J. Stewart, Clerk. Also present: William'E. <br />Olsen, Treasurer, and Frank N. Graham-and Bernard Friel, Village Attorneys. <br />No one wishing to have the minutes read, Utecht moved that reading of the minutes <br />of March 7, 1957, be dispensed with and that said minutes be approved as submitted. <br />Seconded by Warkentien and so ordered. <br />Drainage Trustee Nilsen reported on drainage problems caused by the <br />matters heavy rain coming at this time with culverts frozen, Said he <br />had talked with the County regarding the matter, but was <br />s}g~ wt informed they have similar work of their own which keeps them <br />C~lvcr-~'S busy 12 hours a day. Nilsen asked if he could not check with <br />the County to see if they could work just in Falcon Heights <br />on Saturdays on an overtime basis, steaming out culverts. <br />Utecht moved that Nilsen be authorised to check with the County <br />Engineer and if agreeable to have them work in Falcon Heights <br />on Saturdays, steaming culverts whenever necessary. Seconded by <br />Stewart and motion carried unanimously. <br />Variance Letter of March Ill, 1957 was read from the Falcon Heights Planning <br />request - Commission, recommending that Beim Investment Company and Grudem <br />Beim Investment Brothers Company be permitted to continue the construction of the <br />Grudem Brothers .building at about 1790 Larpenteur Avenue West, but in no event <br />closer than ~2 inches from the property line of Christina R. Kelley's <br />Planning Com. property, the Planning Commission finding as follows: <br />recommendation <br />"(1) There are special circumstances affecting the premises for <br />which the variance is requested; <br />"(2) The granting of this request is necessary for the preser- <br />vation and enjoyment of substantial property rights; and <br />"(3) The granting of this request will not materially affect <br />adversely the health, safety or general welfare, or public or <br />pri vate property." <br />Resolution After discussion. and acting in accordance with the Planning <br />Commission's recommendation and the consent and request of <br />Christina R. Keller, owner of the adjoining property to the west, <br />Warkentien moved that the request of Beim Investment Company and <br />Grudem Brothers Company for a variance in the sideyard provisions <br />of Section 10, of Ordinance No. 8, to permit the erection of the <br />west wall of a building on property at approximately 1790 Larpenteur <br />Avenue West, to be completed but in no event to be closer than <br />!t~ inches from the west property line, instead of 5 feet from the <br />said line as required by said section of Ordinance No. 8, be, and <br />it hereby is, gran ted subject to the condition that provision shall <br />be made to insure that roof water from the building will not be <br />permitted to reach the adjoining property to the west, and subject <br />to the condition that the wall will not be closer than !t? inches <br />from the west property line. Seconded by Nilsen and motion carried <br />unanimously. <br />(The Clerk was directed to mail a copy of the resolution to the <br />petitioners' attorney, Mr. Conrad Sheets, New York Bldg., St Paul.) <br /> <br /> <br />1 <br />J <br />
