~ti4 <br />SPECIAL MEETING, THURSDAY, NOVEMBER 7, 1957 <br />Meeting called to order et 7:35 P.M., the following council members being present: <br />William R. Utecht, Mayor; George J. Shavor, Trustee; Harold C. Nilsen, Trustee; <br />Willis W arkentien, Trustee; Clyde J. Sterrett, Clerk. Also present - William E. <br />Olsen, Treasurer; Frank N. Graham, Attorney. <br />Minutes of special meeting of October 22, 1957 and regular meeting, October 2Lt, 1957, <br />xere ordered approved as submitted. <br />d+'aithnvar3.an~e The council received a petition in regard to making house <br />petition connections to the sanitary stirrer, signed by Julius Fuith, <br /> 1765 Holton Street and 38 other residents on Holton Street, <br /> Larpenteur and Pascal Avenues, asking that the Village xaive <br /> any requirements for substituting cast iron pipes for under- <br /> ground clay the pipes, which the petitioners believe xere <br /> installed in their homes xhen built in 19l~5 or 1946, folloxing <br /> World War II, xhen there was a shortage of construction <br /> materials. The petitioners further stated that none of their <br /> houses have been subject to difficulties because of the use <br /> of clay tile, and that the additional expense of replacing it <br /> with cast iron is unnecessary for public health or other <br /> reasons. About 35 persons xere in attendance. <br />Attorney for Joseph Hamilton, St Paul attorney, said. he represeazted the <br />petitioners petitioners and that inasmuch as the petitioners' homes <br /> mere built back in 191tb, that the installations met all the <br /> effective requirements then so should not be in violation <br /> of any subsequent requirements. <br />State Health The Clerk read a letter dated November 6, 1957, from the <br />Dept. letter Public Heal th Engineer, State of Minnesota, quoting the <br /> Minnesota Plumbing code. on building drain requirements <br /> and on health problems xhich may arise if there is sewage <br /> or sewer gas leakage. <br />St Paul plumbing A note regarding discussion of the matter xith the Plumbing <br />inspector quoted Inspector, City of Saint Paul, xas also read, quoting the <br /> Inspector as saying if the clay pipe xas properly installed <br /> it should be as safe as cast iron, and that he didn ~ t think <br /> there xas danger xhere the rater xas city rater and piped in. <br />Robert E. Greiling, In sparer to the question, if sautisfactory to make sanitary <br />Sanitary Server sewer house connection to the pipe, Mr. Greiling stated that <br />Engineer in his opinion the file met requirements xhere properly installed. <br />Petitioners Julius Fuith, 1765 Holton, and Patrick E. Cody, 1771 Holton, <br /> spoke in behalf of the petition and detailed the large expense <br /> involved for the petitioners if they are required to substitute <br /> cast-iron p~pp for clay tile. <br />Village Plumbing A.J. Falkoski reported on one instance where iron pipe xas <br />Inspector connected to tile. <br />Village Attorney . Asked as to the responsibility of the Village in the matter; <br /> Attorney Graham stated that on the basis of the information <br /> presented to the council there trould be no legal liability <br /> on the .part of the Village in his opinion. <br /> <br />
