ORGANIZED COLLECTION <br />(Minn. Stat. § 115A.94) <br />• At least 180 days before implementation City Council must adopt a resolution <br />announcing intent to organize collection and invite participation of interested <br />persons including licensed haulers in the process. <br />• The resolution must be adopted after a public hearing. Two weeks published <br />and mailed notice is required. Mailed notice must be given to all haulers <br />known to operate in the City. <br />• During a 90 day planning period following adoption of the resolution the City <br />must develop plans for organized collection. Licensed haulers must be <br />invited to participate in the process. <br />• After the 90 day planning period for the next 90 days the City must discuss <br />the possible arrangement with the haulers. If a majority of haulers agree then <br />the City can implement. If a majority do not agree, then the City can <br />implement following the end of the second 90 day period. To proceed the <br />Council must adopt certain specific findings. <br />• If the City and all licensed haulers agree on a plan, then the City can <br />implement without regard to the 180 day period. <br />• After completion of the required process ordinances can be adopted and <br />contracts entered. <br />• <br />104505.01 <br />RNK:O1/29/2003 <br />33 <br />
