13 <br />Section II: MGDPA Summa <br />• What is the role of the Commissioner of Administration? <br />Pursuant to section 13.05, subdivision 4, the Commissioner of the Minnesota Department of <br />Administration is given the authority to approve new uses and dissemination of private and <br />confidential data on individuals. <br />Section 13.06 of the MGDPA gives to the Commissioner certain powers with regard to <br />approving temporary classifications of data. <br />Section 13.072 of the MGDPA gives the Commissioner authority to issue advisory opinions <br />concerning the rights of data subjects and the classification of government data. Commissioner's <br />opinions may be found on the World Wide Web at: www. ipad. state. mn. us <br />Section 13.073 of the MGDPA authorizes the Commissioner to establish a program for training <br />state and local government entities and officials on information policy issues. <br />What are the consequences for not complying with the MGDPA? <br />Pursuant to section 13.08 of the MGDPA, a government entity may be sued for violating any of <br />the Act's provisions. <br />Section 13.09 provides criminal penalties, and disciplinary action as extreme as dismissal from <br />public employment, for anyone who willfully (knowingly) violates a provision of the MGDPA. <br />. Where can more information about the MGDPA be found? <br />The following sources may provide helpful information about the MGDPA and other data <br />practices laws. It is important to note, however, that only the legal advisor for an entity has the <br />authority and responsibility to provide specific legal advice about the provisions of the MGDPA, <br />and other laws, as they relate to that entity. <br />Local government associations -- such as the Association of Minnesota Counties, the Minnesota <br />County Insurance Trust, the League of Minnesota Cities, the Minnesota School Boards <br />Association, the Minnesota Association of County Officials, and the Minnesota Police and Peace <br />Officers Association -- may be consulted for information specific to matters within their <br />jurisdiction. <br />July, 2000 Modet Policy: Access to Government Data & Rights of Subjects Data <br />
