• Agenda item: 6 <br />ITEM: Public hearing and consideration of revisions to the commercial <br />development moratorium Chapter 5 Section 5.02 Development <br />Restrictions and Applicability <br />SUBMITTED BY: Susan Hoyt, City Administrator <br />REVIEWED BY: Peter Bachman, City Attorney <br />EXPLANATION/DESCRIPTION: <br />Background <br />In October, 1992 the city undertook a study of its commercial zoning codes. In <br />order to guarantee that during this process no business uses would be approved <br />that were inconsistent with the possible outcome of the study, the city adopted a <br />commercial development moratorium which restricted new business licenses to <br />those businesses that were specifically permitted uses in the existing zoning code. <br />• Applicability of moratorium after adopted commercial code revisions <br />After the adoption of the proposed revisions in the commercial zoning code, it <br />would be appropriate to revise the commercial development moratorium to allow <br />businesses (that are identified as permitted or conditional uses in the revised <br />commercial code) to apply for business licenses and permits according to routine <br />administrative procedures. However, the moratorium will remain in effect for those <br />uses that are not specifically identified as permitted or conditional uses in the <br />revised commercial zones as well as those uses that are specifically identified as <br />being considered for further study for secondary impacts.
