Meeting Date 12/17/90 <br />Agenda Item E-4 <br />C7 <br />CITY OF FALCON HEIGHTS. <br />PLANNING COMMISSION <br />ITEM DESCRIPTION: Report on the duration of conditional use <br />perms s <br />SUBMITTED BY: Susan Hoyt, City Planner <br />EXPLANATION/DESCRIPTION: <br />The Planning Commission requested that staff determine the <br />duration of conditional use permits in the zoning code. City <br />Attorney, Tom Gedde, was asked about this by telephone. He <br />explained that it is ideal to have the conditional use permits <br />expire when the business closes. However, the City of Falcon <br />Heights code does not identify this as the expiration date. The <br />city attorney will provide a statement about this for the <br />December 17, 1990 meeting. <br />For your information, the following sections of the state <br />statutes and the zoning code are relevant to this discussion. <br />STATE STATUTE 462.3595 SUBD. 3 DURATION <br />• A conditional use permit shall remain in effect as long <br />as the conditions agreed upon are observed, but nothing <br />in this section shall prevent the municipality from <br />enacting or amending official controls to change the <br />status of conditional uses. <br />CITY OF FALCON HEIGHTS CHAPTER 9-15.04 SUBD. 1 (a) <br />A conditional use permit shall applx to the use and land <br />and not to a particular person or firm; any change in <br />land ownership, lease, rental, occupancy or similar <br />change shall not affect the permit or its conditions <br />except as may be specifically authorized and required by <br />the City. <br />ACTION REQUESTED: <br />1.
