This Home Occupation meets all the applicable <br />Code requirements. Therefore, a separate license may be applied <br />• for independently of the Conditional Use permit for the B&B. There <br />is no limit on the number of Home Occupations within a dwelling <br />in the City Code. <br />If_the Commission recommends that a Conditional Use Permit be granted <br />to allow a B&B at 2129 west Larpenteur Avenue, the conditions must <br />assure the City that the facility will not become a rooming house, <br />public restaurant or hotel. The requirements for a Home Occupation <br />and the Zoning Code substantially guarantee that the B&B will operate <br />compatibly within an R-1 zone. However, I incorporated portions <br />of B&B ordinances from the Cities of Stillwater, St. Paul and Minneapolis <br />into the proposed Conditional Use Permit to assure its operation <br />as an owner-occupied B&B. I also included restrictions on the <br />number of guest suites and guests occupying the structure at one <br />time so there is no over-crowding of the dwelling. <br />The following conditions are proposed for your review, comments <br />and revision: <br />1. The B&B must meet all the requirements of a Home <br />Occupation 9-14.01, Subdivision 25 (d) with the <br />exception of 9-14.01, Subdivision, 25 (d-5) and (d-6) <br />as regulated herein. (See Attachment E-1F.) <br />2. The B&B shall be owner managed and occupied during <br />• its operation. (The owner/manager occupation is what <br />is distinctive about a B&B.) <br />3. The B&B shall be limited to two guest suites, a-ee <br />6. Meal service shall be limited to breakfast for over <br />night guests. <br />7. Guests of the B&B may use the swimming pool as regulated <br />by the Minnesota Department of Health. <br />8. The B&B may operate on a 24 hour-a-day basis. <br />9. The B&B shall meet all State, County and City <br />regulations„ licensing and Code requirements <br />including, but not limmited to, the Fire Code, <br />the zoning Code and the Building code. <br />10. The B&B operation shall be reviewed six months <br />after it opens and annually upon renewal of its municipal <br />business license. <br /> <br />4. The B&B shall have a maximum of six guests occupying <br />and/or renting the two guest suites at o~neV~(time. <br />5. No guest shall occupy and/or rent tire- r'bom for more <br />than fourteen (14) consecutive days. <br />
