- ACHMENT -- • <br />- ATT <br />Sec. 1007-34. Variances. <br />(a) Generally. The City Council may grant variances from the strict application of the <br />provisions of this: chapter and impose conditions and safeguards in the variance so granted,. but: no <br />variance: hall be-granted unless the City Council finds that: <br />(1) Because of the exceptional or extraordinary physical surroundings, shape or topographical <br />conditions of the- specific parcel of land involved, a particular hardship to the owner would <br />result; as distinguished from a mere inconvenience, and no reasonable use of the land is <br />possible if the strict letter of the chapter were to be carried out; <br />(2) The conditions upon which an application for a variance is based are unique to the parcel <br />of land- for which the variance is sought and are not applicable, generally; to other <br />property within the same zoning classification; <br />(3) The purpose of the variance is not based. exclusively upon a desire to increase the value or <br />income potential of a parcel of land; <br />(4) The. alleged difficulty or hardship is caused by this. chapter and has not been created by any • <br />persons presently having an interest in the parcel of land; <br />(5) The granting ofthe variance will not be detrimental to the public welfare or injurious to <br />other land or improvements in the neighborhood in which the parcel. of land is located or <br />alter the essential character of the neighborhood; <br />(6) The proposed variance is in keeping with the spirit and intent of this chapter; <br />(7) The proposed variance will not impair an adequate supply of light and air to adjacent <br />property, or substantially increase the congestion of the public streets, or increase the <br />danger of fire, or endanger the public safety, or substantially diminish or impair property <br />values within the neighborhood. <br />(b) No variance shall be granted to allow any use that is not permitted under this chapter for <br />property in the zone where the applicant's. land is located. <br />(c) Applications. Applications for variances shall be made by the owner or owners of the <br />property and shall be filed with the Zoning Administrator. All applications shall be accompanied <br />by an administrative fee as prescribed in section 1007-36 and shall include the following <br />information: <br />(1) A description of the proposed use and how it varies from the applicable provisions of this • <br />chapter; <br />HYPOTHETICAL CASE STUDIES PAGE Z4 <br />
