shall be in writing and shall be served upon the property owner either in person or by <br />mail. <br />Subdivision 5. Penalties. Any person who shall violate any provision of this ordinance <br />shall, upon conviction thereof, be deemed guilty of a misdemeanor. <br />9-2.14 Land Develoument Charges. <br />All applicants for the issuance of any permit or final plan approval shall pay in <br />addition to the fees and charges for platting, subdividing, rezoning, and the <br />permits for variances for land development or redevelopment within the city, all <br />out-of-pocket expenses incurred by the city in employing the services of any <br />engineer, legal counsel, or other professional consultants with regard to reviewing <br />said plat, subdivision, application for rezoning and conditional use permit or <br />variance. <br />9-2.15 Uniform Building Code <br />Subdivision 1. The latest edition of the Uniform Building Code (hereinafter "Building <br />Code"), copyrighted by the International Conference of Building Officials, together with <br />all future amendments thereto, save and except such portions as are hereinafter modified <br />or amended by subdivision 2 herein is adopted and incorporated as fully as if set out at <br />. length herein, and the same shall be controlling within the City of Falcon Heights. Not <br />less than one (1) copy of the building code has been marked as the official copy and is <br />filed in the office of the Clerk. <br />Subdivision 2. Building Permit Fees. <br />a. Section 301 of the Building Code is hereby deleted and the following is <br />inserted in lieu thereof: Section 301. Permits Required. All persons, firms or <br />corporations erecting, constructing, enlarging, altering, repairing, moving, <br />improving, removing, converting or demolishing any improvement, building or <br />structure in the city or causing the same to be done must obtain a separate <br />building permit for each improvement, building or structure from the building <br />inspector. This section shall also apply to all driveways, parking lots, fences and <br />signs. <br />b. Section 304 of the Building Code is hereby deleted and the following is <br />inserted in lieu thereof: (Amended <br />4/14/93, Ordinance 0-93-03) <br />304(a). Definition of Cubic Feet. Cubic feet means the total volume <br />included within the surrounding exterior walls of a building or portion <br />thereof, from the basement floor to the roof line. <br />• <br />23 <br />
