9-15.06 Fees <br />The Zoning Administrator or other administrative office having jurisdiction therein shall <br />charge each applicant, petitioner or other person requesting a permit, rezoning or other <br />zoning approval or review such fees as may be prescribed therefor by ordinance or by <br />resolution published in the same manner as an ordinance. Each applicant, petitioner or <br />other person shall also pay all legal, engineering, planning, and similar out-of-pocket <br />costs incurred by the city in connection with the respective matter. The zoning <br />administrator with the approval of the council may require each applicant, petitioner or <br />other person to deposit with the City in escrow a cash amount based on an estimate by the <br />zoning administrator of such fees and costs. Any surplus shall be refunded to and any <br />additional costs paid by the applicant, petitioner or other person. The obligation to pay <br />such fees and costs shall not be affected by the disposition of the matter. <br />9-15.07 Enforcement; Violations; Penalties <br />a. Zoning Administrator and Citv Attorney. The Zoning Administrator, with the <br />assistance of the City Attorney, shall have the authority to and be responsible for the <br />enforcement of this Chapter. Any complaint received shall be promptly investigated by <br />the Zoning Administrator. If the matter cannot be adjusted by the Zoning Administrator <br />. to the satisfaction of the complainant, he/she shall promptly be reported to the City <br />Attorney, who shall then proceed to enforce the Code according to its provisions <br />following approval and receipt of instructions from the City Council. <br />b. Cancellation of Permits. If any condition in any permit, including variances and <br />conditional use permits, is violated, the Zoning Administrator shall serve notice on the <br />owner of the permit that unless the violation is corrected in the time set by the Zoning <br />Administrator, not to exceed ten days, the permit shall at the expiration of said period be <br />terminated, provided, that if the said owner shall within a period of twenty days from the <br />service of said notice, correct the violation, the order shall be stayed until the appeal has <br />been heard. Said notice shall be served either by personal service or by registered or <br />certified mail, the period herein provided shall be extended by three days, not counting <br />Saturdays, Sundays, or legal holidays. If an appeal is filed, it shall be processed as <br />provided in this Ordinance. If there is no appeal, or if on appeal the Zoning <br />Administrator is sustained, the permit shall terminate and the Zoning Administrator shall <br />refer the matter to the City Attorney for such action as is required under this chapter. <br />c. Injunctive Relief. The Zoning Administrator, upon approval of the City Council, shall <br />have the authority to petition the District Court of Ramsey County, or such court as shall <br />have jurisdiction to hear the matter, for injunctive relief against continued violations of <br />any of the provisions of this Ordinance. It shall be the duty of the City Attorney to <br />represent the Zoning Administrator in the action. <br />13 <br />
