E. Pursuant to Section 16.l~(3) of the Village Zoning <br />Ordinance, the Village Planning Commission has been given an opportunity <br />to comment on all of the variances set foth in said letter. <br />F. The Village Planning Commission after reviewing <br />said variances recommended that they be allowed to continue, except for the <br />requirement in Section 1t~.2(3.7) of the Zoning Ordinance that an opaque <br />fence abbutting a residential district on the east side to be constructed <br />to screen the parking lot. <br />NOW THEREFORE, BE IT RESOLVED by the Village Council <br />of the Village of Falcon Heights as follows: <br />1. It is hereby found, determined and declared that <br />the variances from the provisions of Section 4.7(2), 11.L~(2), 11.l~(~.), <br />1t~.2(3.7), 13.2(3.9), 1~.2(28)e, and 1k.2(3.6) of the Zoning Ordinance <br />existed prior to the establishment of the municipal liquor store is a retail <br />use similar in nature to the permitted uses set forth in Section 11.1 of the <br />Zoning Ordinance. <br />2. The inclusion of a retail liquor store as a permitted <br />use in a B-2 Retail Business District is hereby ratified, affirmed and approved <br />in accordance with Section 11..1 of the Zoning Ordinance. <br />3. Variances from the provisions of Sections 4.7(2), <br />11.4(2). 11.4(4), 14.2(3.9), 14.2(28)e, and 14.2(3.6) of the Zoning Ordinance, <br />as set forth in said letter of August 30, 1972 are hereby ratified, affirmed <br />and approved. <br />4. It is hereby found, determined and declared that the <br />number of parking spaces required under Section 14.2(4.14) of the Zoning <br />Ordinance with respect to said municipal liquor store are twelve, and that <br />a variance from said requirement is hereby granted to the extent that the <br />number of parking spaces provided in the plans and specifications for the <br />municipal liquor store are less than twelve. <br />5. In accordance with the recommendation of the Village <br />Planning Commission, the Village shall comply with the requirements in Section <br />14.2(3.7) that a fence, not less than 75~ opaque, of adequate design, not <br />over six feet in height and not less than three and a half feet in width <br />be erected along the rear lot line. <br />WILLIS C.
