" MINUTES <br />~ REGULAR PLANNING COMMISSION :M.EE'I`IN"G <br />OCTOBER 6, 1980 <br />• The meeting was called to order by Chairman Larsen at 7:30 p.m. In addition <br />to the Chairman the following were present: Mike Heffron, Jerry Wallin, Al <br />Stefanson, Robert Blomberg, Elving Anderson and Council Liaison Person Sandy <br />Larson. <br />Mr. S. W. Hart, 1488 Crawford, was present at the meeting requesting a Con- <br />ditional Use Permit for the purpose of constructing a utility shed on his <br />property. After discussion there was a motion and second recommending <br />approval of the request. The Planning Commission voted unanimously for <br />approval, and so recommends to the Council. <br />Mr. Edwin Schmidt, 1746 Albert, was present requesting both a Conditional Use <br />Permit for construction of a utility shed on his property and a Variance so <br />as to construct the shed 3 feet from the side property line. He had the <br />permission letters from the neighbors on either side of his property. It <br />further appeared that his next door neighbor had a utility shed in approximately <br />the same general location on the neighbor's property. Upon motion and second, <br />the Planning Commission voted unanimously for approval of the request, and so <br />recommends to the Council. <br />Martin A. Christiansen, 1724 Holton, was present requesting the City's permis- <br />sion for the purpose of selling Christmas Trees from his R-1 property which <br />were grown on his hobby farm in Todd County. Sandy Larson pointed out that <br />the City has Ordinance ~~12 which pertains to the licensing of such a venture <br />if, presumably, the Zoning Ordinance is not in conflict. The discussion on <br />• this request turned to a consideration of the Zoning Ordinance, specifically <br />Sections 6.2 (7) and 6.3 (6). The latter appears to permit horticultural <br />activities on R-1 property. The former appears to permit the retail sales <br />of horticultural products if those products are grown on the property. <br />Since the Christiansen trees were not grown on the property in Falcon Heights, <br />there would appear to be a conflict with the Ordinance. Jerry Wallin was of <br />the opinion that the Christainsens would need to request a variance, there- <br />fore. <br />Inquiry was made of Mr. Christiinsen as to whether or not he had the approval <br />of his neighbors who might be affected by his proposal. He responsed that he <br />had informal neighbor approval. He was requested to seek such approval and <br />present it in writing. Although the proposal was not acted upon finally, it <br />was the concensus of the Planning Commission Members present that should Mr. <br />Christaansen be able to secure the approval of his neighbors in the immediate <br />vicinity, that a variance should be granted. <br />Sandy Larson advised that the City has approved a sign ordinance that will <br />prohibit advertising signs (billboards). The ordinance repeals Sub-sections <br />4.5 through 4.9 of current Section 14.1 of the Zoning Ordinance. The Planning <br />Commission was unanimous in its feeling that the repealer was too extensive <br />and that Sub-section 4.9 should not have been repealed. Sub-section 4.9 <br />would allow a shopping center to erect a sign under one name or similar <br />circumstances. Such a sign would not appear to be within the prohibition <br />intended for billboards. <br />Sandy Larson also advised that the City Council has approved a swimming pool <br />ordinance. <br />
