MINUTES <br />REGULAR PLANNING COMMISSION MEETING <br />JANUARY 9, 1989 <br />Chairman Black called the meeting to order at 7:35 P.M. <br />Black, Nestingen, Duncan, Grittner, Barry, Daykin, Boche and <br />Finegan. Also present was Counci]_ Liaison Wa]_lin and Planner <br />Malloy. <br />Carroll. <br />Nestingen moved, seconded by Finegan, approva]_ of the December 5, <br />1988 Minutes as presented. Motion carried unanimously. <br />Black opened the public hearing at 7:45 P.M. and advised that notice <br />had been published in the Falcon Heights Focus on Wednesday, December <br />21, 1988. Black explained that a request had been received to open <br />a business in the Northome Shopping Center as a game arcade but <br />before such request could be acted upon, the City Code would have <br />to be amended to add such use. City Staff suggested amendment of <br />Section 9-10.01, Subd. 2. There being no one present wishing to <br />be heard, the hearing was closed at 7:55 P.M. <br />Discussion ensued on whether game arcades should be allowed in the <br />• City of Falcon Heights as there was neighborhood opposition to such <br />an operation previously due to continual problems encountered by <br />residents. Since game arcades are not covered by statute, to merely <br />deny a property owner the right to use his property as he wishes <br />by mere refusal to amend City Code is arbitrary. If the game arcade <br />were included in the conditional use section of the City Code, certain <br />conditions could be placed on such use to limit neighborhood concerns. <br />After further discussion, Boche moved to include game arcades as <br />a category in the conditional use section of the City Code. The <br />motion was seconded by Daykin and upon a voice vote, the following <br />voted in favor thereof: Daykin, Boche, Black, Grittner, Nestingen <br />and the following voted against the same: Barry, Finegan and Duncan. <br />Motion carried. <br />Dennis Hunt requested a variance for parking to open a take-out <br />de]_i in the Bullseye Plaza Shopping Center. The deli will be 1,020 <br />square feet in size. Henry Kristal, representing Embers Restaurants, <br />requested that the Planning Commission consider: (1) there is not <br />enough on-site parking for another eating/take-out establishment, <br />and (2) the shared parking agreement cannot continue if another <br />eating establishment were to go into the west end of the Bullseye <br />building as there is not enough parking. Shopping Center employees <br />are using the east end of the Embers lot for parking instead of <br />using the liquor store lot which has been no problem until this <br />time, but this practice could not be continued if another restaurant <br />were established on the west end of the Bullseye building. The <br />larger picture needs to be examined for parking for the entire center <br />and its tenants. <br />
