Mr. plant opened the meeting with a statement that this was to be a public <br />hearing on an application aiid petition for rezoning from R-3 to B-2 of that <br />real estate described as: <br />"The .East 158.62 feet a the South 265.12 feet of the ~ of <br />Section 16, Township 29, Range 23 <br /> <br />"{also described as the Roberts Construction, Inc. property near or <br />at the Northw8st corner of Fairvie~r and_La,rpenteur ~venuss in :said r <br />Vills.ge) " <br />The petition t-as presented by dlr. John Dabney, representing the owner of` the <br />property, Mr. Roberts. Irir. Dabney stated that of the 19 land parcels :within <br />300 feet of this property, signatures were obtained on the petition for re- <br />$oning from 15 of the owners . Only .four did not sign. <br />Next the meeting suss opened to discussion from the flor~r. ihrs. Summers who <br />lives directly north of the lat under consideration spoke in favor of the <br />petition. <br />Fourteen other residents spoke against the proposal for the following reasons: <br />1. theme are already enough filling stations in this :area {22 within one <br />square mile); 2. if the ordinance is changed to allow business here, it will <br />encourage future attempts to rezone and sill end 4Tlth the scraping of the <br />ordinance; 3. Falean Heights' greatest asset is its fine residential area. <br />should keep it that way by maintaining the stability of the coning <br />ordinance. Those who spoke against the rezoning petition ire ~~r. Joseph <br />Bianchi, Mrs. Marguerette Youngner, abr. ~,ndrew Husterlid, Cdr. and i~r~s. ~lil <br />Anderson, I~r. A.. J. Schwantes, ~tlr..~'lving V. ;Anders tom, Tyr. George Pederson, <br />dir. ~~,rry Baden, l~sr. Donald Shannon, Mr, Harley J. Otto, i~r. Christ Steiner, <br />and t~vo others . <br />The question was raised concerning the set-back on Fairview for an apartment <br />building on this lot if the rezoning was turned down, I~r. Galvin quoted-the <br />ordinance -- Sec. &.4.2 -- that a side lot abutting on a street shall be not <br />less than 30~. Altho the houses on Fairview are set back 50~, I~r. Galvin <br />stated that Tyr. Dahlgren had felt that the set-~t~ack #-or an apartment should <br />be 30~ as the building would then act as a better buffer between the <br />residences and Larpenteur. DA.rs. F,mi1 Anderson suggested that a sst-back of <br />40~ be considered. <br />The planning report made by ~did~vest Planning and Research, Inc. indicating <br />the inadvisability of rezoning this Fbt of iand ~+a.s read. <br />Mr. Libby moved seconded by Mrs. Hardie, that the Planning Comrcti.ssion <br />recommend to the Village Council that the<applicatian for x+ezoning the grc- <br />perty at the northwest corner of Fairview=and Larpent~eur from R-3 to B-2 be ~ <br />denied. The motion yeas carried unanimously. <br />
