Mamo
Page ~
This device would serve as a :r~Eanv for informing the public
and the Uf~i.versity as to the intended. use os propex'ties ii'
the University were to re3.c-use ~~or areas of land for private
development. Such a plan ma.:~ntaine~. as a reference by the
Vi].]~ge is also a useful dov3.ce far considering any future
ch$nges in Jose. To give t'nis plan ma~~.~am le~l stature it
is suggest~a. ths3.t it be adop'~ed prior to the adoption of the
Zani.ng Ordinance. TY~t is to s°y, the zoning map should
implement the projected Comprehensive Plan. Zan3.ng when based
on such a Comprehensit*e Plan carries ecnEiderable more weight
in any court litig~Lion.
The following it::uis refer. to the letter from taestern
Oil and i'uel Cam~:sny.
7. Service Stations as Permitted Use
The 20ning text 11ow 6peCif7-P-3 that $~'rViGe ~t~'t~ Ons 8re a
conditional use in the "B-2" Aistrict and are not permitted
in the "B-1" o~ the "B-lA" DLstricts. The amount of "B-2"
lan~3. avai]~ble in the Village is extr~¢::ly limited. Thus, we
Peel it is appropriate to use the service s'~tion as a conditional
use in such districts. The "B-1A" District is oriented primarily
toward the higher type office, research or ligYit processing deve-
lopment, and is located in all ce.ses contiguous to open agricultural
land or residential properties (multiple, duplex, or single famia-y)•
Though it may be true a service station could be constructed on
one of the "B-7.A." areas, this could be accomplished by rezoning the
procperty to °'B-2" . In other ~rorcls, P'~ purposes of categorizing
reasonable coaagatible uses t~3.thin 'ihe "B-1A" D3.strict ire Peel that
service stations are not appropriate. If service stations were
allowed as a Conditional use in a P0B-1A." T2istrict it would be
reasonable to allow a great many other retail operations as well.
This was not the intent of thA district. It should be remembered
however, that iP it can be demonstrated that a service station is
desirable, such a station can be accommodated ',hrough a rezoning
process.
8. Set-~3ack of Islands
Some of you ~y have noted t12at the Village of gloomington~is currently
considers requiring puu?p islands of service stations to be set-back
100e in their so called "freeway development distmict". This is
indicative of a trend tlarou~iout the country to some~.~hat reduce the
conspicuous role of s@rvice stations on our right°of-ways. .The 100Q
proposed in Bloomington is vet questionable and certa~.nly would not
be appropriate for Falcon ~Ieig}zts, Gee do feel however, that the remaining
1 land available in Falcon Heights is of such a nature that
eammercia
a 30Q set back is not unrs~scr~ble. Should a spesi.fic site produce
a particular hmrdship in adhering to this requirement, a variance
can be granted reducing this req~.rement somewhat. The minimuya
standard used in the past is usually 20°a
