Vince and George excavated the property stakes <br /> and placed flag markers in them. Mr. Pittelkow ran a string line <br /> between the two flags. AlthougH the elm tree cut down in 1991 was <br /> only 32.5 inches in diameter, the stump area ground out was about <br /> 6 feet in diameter. With the string set up, it was clear that the <br /> bulk of this area was on private property. Vince and George <br /> concurred. Mr. Pittelkow asked us to measure from the street, the <br /> way boundaries are routinely established to determine tree <br /> ownership. Mr. Pittelkow supplied a measuring tape and Vince and <br /> George measured the distances. Using this method, all of the <br /> ground out stump area was totally on private property. <br /> I told Mr. Pittelkow there was no question that the elm tree had <br /> been on his property. Mr. Pittelkow responded that he didn't <br /> agree. I asked him why he thought that way. I pointed out that <br /> there was nothing that could be done to be more accurate in <br /> determining where the tree had been. He said he thought maybe 40% <br /> of the tree had been on public property and 60% on his property. <br /> I told him I didn't know what percentages were involved but that <br /> the majority of the tree had clearly been on his property. <br /> I mentioned the fact that life is not fair and that many people in <br /> the city have had to pay to remove diseased elms. I photographed <br /> the flags and string marker from both directions in respect to the <br /> ground out stump area.
