6 -4.01 6 -5.01 <br /> G. No license shall be granted or renewed to a person <br /> to whom a license may not be granted or renewed <br /> under the provisions of Minnesota Statutes, <br /> Section 340A.402. <br /> H. No license shall be issued if the city council <br /> determines issuance would not be in the interest <br /> of the public. <br /> 6 -4.02 Places Ineligible for License <br /> A. No license shall be granted for any premises where <br /> a licensee has been convicted of a violation of this <br /> chapter or where any license has been revoked for cause <br /> until one year has elapsed after such conviction or <br /> revocation. <br /> B. No license shall be granted for premises within <br /> 300 feet of any elementary or secondary school or <br /> within 300 feet of any church. <br /> C. No more than one (1) off -sale intoxicating liquor <br /> license may be directly or indirectly issued to any one <br /> person or for any one place in the city as provided by <br /> Minnesota Statute Section 340A.412, Subd. 3. <br /> D. No license shall be granted for premises precluded <br /> from licensure by Minnesota Statute, Section 340A.412. <br /> E. No license shall be effective beyond the compact <br /> and contiguous space specified in the license for which <br /> it was granted. <br /> F. No license shall be granted or renewed for <br /> operation on any premises owned by the licensee <br /> or the licensee's agent on which taxes, assessments <br /> or other financial claims of the city are <br /> delinquent and unpaid. <br /> SECTION 5. LICENSE FEES <br /> 6 -5.01 A. Payment of Fees. The city clerk shall not accept <br /> an application for license unless the fees are paid and <br /> all forms signed. Upon rejection of any application <br /> for a license, the amount paid shall be refunded. <br /> B. Establishment of Fees. The city council shall <br /> establish the annual and event license fees for the <br /> issuance of licenses for alcoholic beverages. Specific <br /> fees are identified in Chapter 5 -5.01. Fees for new <br /> licenses shall be pro -rated on a quarterly basis. <br /> C. Refunds. The city shall refund to the licensee or <br /> the licensees agent a prorata portion of the annual fee <br /> for the unexpired period of the license, computed on <br /> a monthly basis, when operation of the licensed <br /> 6 <br />
